Congratulations Oti, I hope my wait in Dallas wont be too, I hear its back logged but however our timelines are similar. My case was approved in December, I485 transfered to another office in Febuary. I understand that Dallas is a year behind :(

Thanks coolbeans. I can't wait to have it on hand as of today I had another update on my case that my card was picked up by USPS and they provided a tracking number which shows it will be delivered on Friday.

I will keep you in my prayers tonight. I know how it feels my dear,be strong u r almost there!

Thank you for your time. I married my wife in Nov 2015. Lived together after marriage for 6 months and now currently separated because of her drug addiction. She emotionally abused me by using me financially, threatened my green card marriage interview, and put me through a lot of pain and suffering, in order to support her drug addiction. We had already filed the I-130, I-485, and I-765. This is what my VAWA file has so far:

1. Married a USC = Have her birth certificate (born in California).

2. Proof of living together = Have joint renter's insurance, joint lease agreement, and letter from landlord, both our driver's license with same address.

3. Proof of Bonafide Marriage = Have joint auto insurance, joint bank accounts, beneficiary on my Roth IRA, joint car title, marriage certificate, photographs before wedding, during wedding, and after wedding with her and her family.

4. Personal Declaration = I wrote a detailed 7 pager discussing how our relationship came to be, how it developed, how we got married and why, and then discussed the abuse in chronological order emphasizing what she said and did and how it made me feel. Discussed my good moral conduct about how I have not been in trouble with the law and volunteer for a day care with kids. I also discuss the hardship of being sent home and how it would ruin me because I would be disgraced by my family.

5. Psychologist Evaluation = A report that describes me, how my relationship developed with my wife, the abuses suffered, and the tests performed on me. States that I am suffering from PTSD and Depression and in need of serious counseling and therapy.

6. Affidavit Letter = My sibling who lives with us was a witness and wrote a letter describing his observations of the abuse.

7. Good moral conduct = Letter of clearance from Police department. Clean record.

My simple question is, do I have a valid case here just on what I listed above? I consulted a "female" immigration lawyer and she stated that my case looks weak because VAWA is generally for women and immigration officers look down on male related abuses. Furthermore, she thinks my wife didn't "intentionally" meant to abuse me. She was a victim of her own drug abuse and just happened to take it out on me. To me, this made absolute no sense whatsoever. If the tables were turned and instead of me but my wife told her that she was a victim of abuse based on what happened, don't you think the woman would have gotten a different preferential treatment? The lawyer said to suck it up, and go and fix the marriage and show up to the interview. What she fails to realize, my wife is a ticking time bomb. She always promised me she would seek treatment, but no matter what I did to help her, it all backfired, and she tried to take me down with her. So I don't really want to fix my relationship anymore. I'm scared and frankly living in fear of what to do.

Any advice you can send my way, I would totally appreciate it.

Hey you may want to be careful mentioning that ur wife is a drug addict esp if ur statement gives the inference that you knew she was an addict b4 u married her. I filed vawa too as a man but i believe filing as a man is more sensitive than filing as a woman. However pls follow sandras expert opiniom. Looks like u hv a good case but dont implicate ur sef pls

Thank you. I see another immigration lawyer tomorrow, but getting broke each day with these $150 consultation fees. I guess I'll see what he says. Haven't heard from Sandra yet :(

male nonimmigrant you said "We lived together after marriage for 6 months and now currently separated because of her drug addiction" you didn't describe here any abuse, then I can't say if you have a VAWA case or not.

Many people think that having a spouse drug addicted, alcoholic or bisexual is important for VAWA but USCIS does not consider these things abuse, they consider an "unpleasant marriage". If you drafted your affidavit mentioning basically about her drug addiction then do not expect to be approved because of her addiction.

If your psychological evaluation did not mention IN DETAILS all abuse suffered, USCIS won't consider the evaluation,especially if you attended just one therapy session.

USCIS ask to mention the number of sessions, the onset of problems,diagnose, the treatment recommended, well-being before the abuse. I have people every day asking me for help because they got RFE regarding abuse and most of the time the problem is a short evaluation/single therapy session.USCIS approves male or female without discrimination,abuse is abuse, gender doesn't matter.

Thanks for your response Sandra. Here's the extent of the abuse:

(1) Controlling me = Pulling me out of my activities to forcing me to take her home because she needs her drugs and wants me to leave social events that we leave together. Causing a scene in front of people.

(2) Refraining from having sex with me because she was not in the "mood" because of her symptoms, but then belittling when we did have sex that I was not good at it. Caused me to have low self esteem and suffer from erectile dysfunction. Then one day told me that since I can't get an erection, that she will penetrate me instead with a strap on.

(3) Threatened to not attend marriage interview if I did not help her obtain her drugs.

(4) She cut her wrists to scare me one night and made me live in fear because she said that I was the one who caused her to feel suicidal as I won't help her with getting her drugs.

(5) Has threatened with divorce if I told her family about her addiction.

(6) Has taken money out of our joint account, primarily my money most of it, to go buy drugs off the street and put me in financial stress as I am unemployed and still waiting on my EAD.

(7) Made me sleep on the couch in the living room.

(8) Has pushed me once when I was trying to help her that I fell over the shoe rack.

Regarding psychologist, her report his thorough and has outlined all the abuse. And I have been seeking therapy. Multiple sessions.

malenonimmigrant If you describe to USCIS how you described here believe me you won't have your case approved at all.What you described here I see as "an unpleasant marriage, not abuse". Abuse is a pattern of humiliation,isolation,degradation,control,threats.

I had hundreds of male cases approved, but so far I not seeing abuse in your case considering what you are saying.

What is your diagnosis? what kind the tests you psychologist performed to diagnose you?

VAWANEHI you said 'lawyers don't understand VAWA', maybe attorneys that you know, because I am an attorney and I have over 6.000 VAWA cases approved.Just today I had an AOS approved, he is a Visa Journey member (Vawa) .Last year hundreds of VJ members had their VAWA cases approved.
