Lina 3 he will show up for the interview and because you do not live with him anymore the officer will deny your AOS, but it's not a big deal, just refile the VAWA along with a new AOS.You should go to the interview as well, once you will file VAWA do not enter with him.Usually, USCIS put on hold the AOS until final adjudication of the VAWA when the beneficiary shows up alone and tell the officer that she/He will file VAWA, but because your husband will attend the AOS interview the IO will deny your AOS. Don't panic,it's normal, and rush to file the VAWA.

Wow thats cool Sandra. How long did the case take that got both vawa and AOS approved?

Since congressman inquired about my case, uscis changed my jurisdiction from houston to iowa des moines 2 weeks ago. I have been waiting since 2013!! So freaking tired. And the congressional enquiry said nothing was wrong with my case. I hope they speed things up now that congressman has checked on it.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

@Skazzka or anyone who filed AOS/EAD w fee waiver after VAWA approval:

How long was the wait from when USCIS received your pkg to the date you got the notification /NOA of receipt /case #s? Am just trying to figure out a timeline because I have not received any notification & today is end of the 3rd week.

Hi folks.This week I had 5 VAWA cases approved, and one girl that I helped with her VAWA and AOS USCIS approved her GC WITHOUT INTERVIEW.

So NBC approved her GC without interview or her local field office did? They gonna send her 10 year GC within 1month?

Local office approved the case interview. Probably within 10/15 days she will receive the GC.Her husband is a green card holder then she had to wait a number became available. But almost all my cases took from VAWA to AOS 4/6months.

In the past, I had two other AOS approved without interview.

Hi, I am new here and I heard the wonderful work of sandranj. God bless you.

I am in the process of filing vawa. My US spouse is abusive and will not attend the interview for i-130 when it is scheduled. While i meet all the requirements for vawa, the problem I am having is evidence of joint lease. Because we lived together in my brother's house for 2 months, while waiting to raise fund to get our own apartment before the abuse started.

Do I still stand a chance of getting my vawa approved if i provide all requirements except evidence of joint lease? Can affidavit from my brother stating that i lived together with my abusive spouse in his house okay as evidence that we lived together? please advice
