laughingcow1 you CAN'T postpone the interview because you will file VAWA.The right thing to do is to file VAWA BEFORE the AOS interview. Attend theAOS interview and ask the officer to put on hold your I-485.I would say 90% of the times they put the AOS on hold. Showing up to the interview without having VAWA filed you are risking to have the AOS denied, but if they deniy you file again.You need to be fast because after the denial you will receive a notice to appear in Court for your removal.

Lina 3 renew your DACA. Attend the AOS interview and ask the officer to put on hold your I-485.Make sure your affidavit has details about the courtship (2/3pages), when he introduced you to his family and friends, who attended the wedding, if you had any celebration. Describe the abuse in details mentioning, at least, month and year that the abuse occurred, describe how you felt about the abuse, mention why you stayed with him even after the abuse started.Describe your life and mental state before you met him and after the abuse.

Thank you Sandra. I'm working on vawa application now. I have good evidence for bona fide marriage (bank statements, family members' affidavits), My previous boss, my parents and a friend are willing to give statements regarding the abuse (I don't know if I'll have time to gather them before i submit i-360). I'll need to complete a psychological evaluation, which i don't think will get done in time. I think it's best for me to submit i-360 before my i-485 interview and bring the i-360 receipt to the interview to have my i-485 put on hold. I can send in the rest of the document when they issue me RFE. Do you think it's doable?

Also I'm working on my personal statement of the marriage and abuse now. I wonder if you have any tips you can share with me.

In my opinion, when one VAWA gets an RFE is because the case was badly handled.As I mentioned before answering Lina post describe the courtship in details, tell about the proposal and wedding in details, mention the abuse in details mentioning, at least, month and year that the abuse occurred, describe how you felt after the abuse occurred, explain why you stayed with him after the abuse started.Describe your life and mental state before you met him and after the abuse.Mention who knows about the abuse.Try to finish your affidavit as soon as possible,gather affidavits from your family and friends, attend once or twice per week therapy and in 20 days you will be able to have everything ready.

Thank you Sandra. I'll take your advice. I think i mentioned in my previous post that I would like to change my first name through the court due to religious reason. I wonder if I can do it now and later on bring the court order to my I-485 interview, or do you not advice me to change my name right now.

Hi, All

Well, here I am on the VAWA situation as many of you. I hired an attorney to help with my case and I've had the worst experience you can imagine. After over 1 year of dragging their feet, my attorney finally decided to file but I have no idea what exactly they sent to USCIS (I requested them to let me see my file, so I'm working on getting that info). I have a few questions now that I got the receipt in the mail:

1. I already had an AOS case pending before separating from my partner who is a LPR and the priority date was already current. I would like to know how to transfer that same priority date for the i360. The receipt I got in the mail, does not have a priority date on it so I am wondering if the attorney didn't let USCIS know that I already had a priority date? Is there a way to know? I am afraid that USCIS will not use my previous priority date and I will have to wait considerably more time.

2. I have my EAD which I will need to renew next month (120 days before it expires) from my AOS from the i130 case. Do I need to send the renewal information based on the AOS application that USCIS already has? (this is one linked to the original i130) or will a new AOS aplication will have to be submitted based on the VAWA i360?

savingcavemen the priority day is the date the petition was filed with USCIS.If your priority date is current your attorney should inform USCIS.

If you have a pending AOS you can file the I-765 based in the I-485 that you submitted before.But you said your attorney took one year to submit the I-360 then I don't believe your AOS is still pending.If your AOS was denied you have to file a new I-485 and I-765.

Oti, I am in the same situation waiting for interview date. My file was transferred to another office (NBC) 4 months and 2 weeks ago. I am not sure when exactly it was transferred to my local office. But I checked processing times for my local office and it says as of January 31 they processed July files for I485. It looks like it is the same for Houston. But last update for their website was done March 14 so I am waiting for new update. So I am waiting too and hoping that they will schedule me soon for interview.

Skazzka and geoheaven my case was transffered on Dec 30 2015 and NYC office responded yesterday i got a letter for my interview its in May 2016. so i hope guys you get your dates soon its about time for things so start moving for us we been waiting for so long.

Sandra what do I need to reapply my work permit?. My lawyer says I have to wait till May.but as of next week it will be exactly 90 days before my permit expires. Question can I do it myself? Or it has to be done by her.
