If they started removal proceedings without my consent (just in case) can I still file VAWA?\

What if I'm still working on my documentation, can I still file? I need medical records and other records of abuse to support my case.

Dear All,

I applied for VAWA 2 weeks ago. I got a RFE for good moral character this week in the mail. USCIS specifically want me to get a Texas police clearance before they will issue a prima facie. I did not submit I-485 with my VAWA application. However, I have a pending I-130 and I-485 at the National Benefit Center that has not been transferred to the local office (Houston, TX center). Can I contact USCIS National Benefit Center to transfer my I-485 to my VAWA application? I do not plan to go to I-485 interview with my wife. We currently do not live together. She never provided evidence that her previous message was terminated or that the husband she married before me died. When we got married, she told me she was never married in the past. I suspect her of bigamy. I plan to divorce her as soon as possible or get annulment of our marriage in case I can confirm the bigamy that I suspect her of. Thank you.

Was your I-485 denied directly at the National Benefits Center or at the local office? On what basis did you file for the I-485? Was it from I-130? Thank you.

Yes, at the Houston office from I-130. I can count the number of nice things I've heard about the local office (almost none) though I understand its due to the high number of immigrants in this city.

Hi Sandra,

I think there is only you can help me now. This is an EMERGENCY.

My vawa was approved and the case was transferred to local office.

I received email from USCIS requesting evidence on 12/10/2015, and it said if I didnt recieve the request by 01/09, I have to contact USCIS.

Since I have my lawyer file my vawa case, all my documents were sent to his office.

I paid him all the fee for the case so now I cant contact him. I called, texted, emailed, called office, he never responded since I paid him the last payment.

I am very worried now.

Can I call USCIS to resend the request to my new address (since I moved after I filed vawa)? Last time I called USCIS before my vawa approved, USCIS denied to give me any information about my case, said they just give info to the lăyer.

Can I change to new lawyer? I am totally broke now and in debt because I loan money to pay lawyer fee.

PLEASE HELP ME. I am very worried and feeling lost and blue now

Linh Luong you have a few options:

1-Write him a certified letter saying if he does not provide you the original copy of the RFE you will register a complaint with the Bar Association for violation of the rules of professional conduct. It's up to you to continue with your attorney representation or not.

2- Fire him through certified mail stating he abandoned your case because he did not return your phone calls and emails for an extended period of time and that you will register a complaint with the association and you might file a lawsuit for malpractice. Ask him to provide a copy of your file in 24 hours.

3- If you fire your attorney then send it a letter to USCIS saying you are representing yourself and all mails must be forward to your address, and submit to USCIS a copy of the letter that you fired your attorney, plus a copy of the USPS receipt.

4- File an e request https://egov.uscis.gov/e-request/displayNDNForm.do;jsessionid=abcVk1SLN0EQTeAoTriiv?entryPoint=init&sroPageType=ndn

5- Fire your attorney and go to infopass to request USCIS a copy of the RFE.

I believe the option 01 is more effective.But clearly you have problems with your attorney then you have to decide if you want to continue with his representation or not.
