Mcby you don't have to leave to file VAWA.You just file VAWA and that is it, assuming that you got married with who sponsored your K1 visa.

dababe IT'S NOT normal, you said the officer interviewed you based in your VAWA approved.Usually, USCIS gives the decision on the spot or within a time frame of 150- 15 days after the interview, just in some unusual situation they may take 2/3 months,but t's not common at all.

I had a case like your case a few weeks ago, the girl and I thought that her VAWA was pending. She was called to attend interview regarding the I-485 filed when she was married living together with her husband , the officer informed that her Vawa was approved and decided to interview based in her VAWA approved,she never received the I-360 approval letter. She got her GC 10 days after the interview, but the officer instead to issue the permanent GC he issued the GC valid for two years,we are fixing the officer mess now. Your attorney should contact USCIS.

Thanks Sandra.... I'm so confused. I realize my case was done in somewhat reverse so I thought ok, just wait. My approval Came just the Feb.1.16 & the IO did my interview in Oct. 20.15 while I waiting the approval.

I going to give my attorney a call & asked her to please contact USCIS.

Refusing to sign l-864 is not considered abuse. Abuse is a pattern of isolation, control,degradation, isolation,threats etc.

Some abusers use the immigration status to threat the spouses with deportation,saying he will "deported her " and never more she will see will see their child again,of course in cases like I mentioned clearly the victim has being subjected to emotional and psychological pain,but to configure abuse the victim has to prove because of

the threats she is suffering major depression or post traumatic disorder.

@geohaven i call the uscic number and the guy told me to wait for April/May we might get a interview letters according to NYC local office time frame is gonna be doing Sept/October filers.so let just wait and see and also i will keep you posted if i receive anything from uscis.

Hi Geoheaven!

The USCIS website said my case was received at the local office (NYC as well) on September 12th, 2015.

Apparantly this was wrong, my lawyer got an email saying they only received it on December 12th, 2015.

My interview notice was sent out on February 17th, and I got my interview two days ago (March 24th, 2016)... I was approved :)

If they send them out chronologically, you should be getting yours soon.

- Paperwork for Green Card received by USCIS: May 3, 2013
- Interview date: 24 March 2016: approved! (after 3 long years!)

- N-400 sent out: December 26, 2018
- NOA1/priority date: December 31st, 2018
- Biometrics: January 30th, 2019

Hi guys!

I FINALLY got my interview two days ago and I was approved! My case was a real pain, but I'm so happy turned out well in the end!
Here's my timeline:

  • - paperwork send out (I-360 and I-485 send out together): April 2013
  • - received by USCIS: May 3, 2013
  • - approval I-360: July 23, 2014
  • - I-485 status changed online (for the first time since May 3, 2013): Sept 9, 2015: case transferred to another office for processing, lawyer received notice saying it was transferred to Missouri
  • - Case transferred to local office (New York) according to USCIS website: Sept. 12, 2015
  • - Case actually got to local office: Dec. 12th 2015
  • - interview notice: Feb. 17th 2016
  • - interview date: 24 March 2016: approved!

- Paperwork for Green Card received by USCIS: May 3, 2013
- Interview date: 24 March 2016: approved! (after 3 long years!)

- N-400 sent out: December 26, 2018
- NOA1/priority date: December 31st, 2018
- Biometrics: January 30th, 2019

I am waiting for my interview to be scheduled, hopefully based on your timeline and uscis website, I will get interview notice end of April, beginning of May. As it gets closer, I feel more nervous about it.

I was really nervous, I thought it was going to be in some type of police-interrogation-like-room, but it was just in some office, the lady had pictures of her kids on the wall. She was very nice. She knew my lawyer and they were even joking about something.

I had to bring my passport, marriage certificate, divorce certificate, birth certificate + official english translation and the interview notice.

At first you have to stand up and they swear you in. She only double checked my birth certificate and made copies of the divorce certificate.

Then she made me state my full name, asked if I ever used any other name, if I have any kids, she made me state my parents' name, marital status, where I was born. She double checked my safe address with my lawyer, to make sure they can send the green card there.

Then she said she was going to ask me a bunch of yes/no questions, I don't remember all of them but here are a couple of examples: have you ever been part of an organization, terrorist organization, have you ever sold weapons to anyone, have you ever been member of a military anywhere in the world, have you ever stayed in the US illegally, have you ever helped anyone cross the border into the US illegally, have you ever sold or smuggled drugs, have you ever been arrested, convicted of a crime, have you ever commited a crime for which you haven't been arrested, have you ever discriminated somebody for their race or religion. My answer was no to all of them.

Then she gave me some letter saying "Notice of interview results". It says: you just have completed your interview. Uscis is unable to complete your case at this time. Your case is being continued until a final decision can be made.

On the letter they mention three options: Your case is begin held for review / Your I-485 is complete but your priority date is not current / your case is transferred to USCIS office servicing your new address. She ticked the box at the "your case is being held for review".

My lawyer said they rarely approve someone on the spot, but you usually get an answer within 2-3 days.

She then said she will contact me if she needs something else, if not I should get the GC in the mail within 30 days.

It didn't even take 5 minutes :). I had to be there at 7.30 in the morning, I got there at 7, and I was out by 7.45 :D.

When we went outside my lawyer congratulated me. When I checked my case status online about an hour later it already had changed to: Your new card is being ordered for production. A couple of hours later they updated it to: Your I-485 has been approved. Case status has been the same since.

Patiently waiting to get it in the mail now!! So happy!

Has anyone here tried to expedite their case? I tried expediting my i765, but just got a letter that they cannot answer my inquiry over the phone or through a referral and I have to submit everything in a written form. Has anyone had to deal with it before?

I filed under c14 and emergency is that I'm type 1 diabetic and without being able to work cannot afford medicine. Ended up in the hospital 2 times last year with complications and almost died.

@AnastasiaE; So sorry to hear about your medical dilemma...I am in the same predicament...sorta..My atty has still not submitted my AOS after my I360 approval and is refusing to answer my calls. I am so stranded in need of a job so I can afford my medication but this does not seem to concern my atty at all. I had requested at least to have my I765 expedited but nothing has moved. Am just praying and waiting....
