Hi! I would like to ask regarding my status.My husband is a permanent resident and he wants to petition me the soonest possible time because my son is sick and has a cancer.He is treated in CHOP in USA.He is also a resident there.What is the fastest way to get an expedited petition because my son badly needed me?thank you

Thank you for giving me an idea.ya it's ok for me to have a nonimmigrant visa or humanitarian parole while waiting for my immigrant visa.As long as i can see my son and be beside him at this moment beacuse he needed a mother to care for him at this rime

As mentioned before, Humanitarian parole is the fastest way to see your son. It takes almost 20 months on an average now from the time you send I-130 application to the time you get into USA on F2A visa.

One more thing you can do to quicken the process. Ask your husband to go see the senator or a congressman in the state where he is in USA with all the evidence and paper work. They can write a letter to the embassy with all the evidence and this will certainly quicken the process and adds more validity to your claim. I have done this before to get a business visa for a colleague of mine from India and it worked.

I am sorry you have to go through this with your son. My prayers will be with your family.

congress cannot change the PD of a petition. In order to get a B2 visa, the CO has to be convinced (by you, not some congressman) that you would depart the US when it's time.

If you failed to get the B2, your husband could apply for HP, but the purpose of HP is not to circumvent the visa process, and thus is far from a certainty to obtain. HP is not processed by our embassies overseas and cannot begin until you apply for some sort of visa and are turned down.
