Hi, im edward and i need some help or information.

Im a permanent resident and currently living here in portland oregon.

Im planning to process a petition for my wife, shes in the philippines.

I know i need to file for f2a petition..but my problem is, my wife has her son technicaly im not the biological father and his 5years old.. if im going to process petition for my wife f2a can she bring her son with her. What are the things needed and fees to pay ..please help..

Yes. Her son can immigrate as her derivative beneficiary, or you can petition her son separately. Your step-son is considered your child for immigration purposes as you married his mother before he was 18.

p.s. Did you marry before or after you got your permanent residency?

Yeah were married just a month ago...i want back to the philippines after i got my green card in may 2015..

I was advised by 2 things...rapidvisa told me i can file for a petitio for my stepson and my wofe seperately but i know that once i process a petition for my wife i can just put my sons name as a deliverate benificiary on i130 right? In that way i dont need to file for 2 petition...should i pay 420x2 or just 420 is enough for them?..thank you, i appreciate it so much

Hello Edward if you fill up one form you pay 420$ if you send separate form it ll be double.

And you ll pay twice all the fee during the process until the fee for green card after interview.

My husband did it for my kids and I .... Like this it s done.... It s more easy to spend that money now instead when you have to take care of you familly with all the expenses. Just my opinion.

The point it s to pay only one time when you became U.S. citizen and you kids are automatically citizen too.

Ok i understand now...once i file for i130 for my wife with my sons name on it as a derivative beneficiary..i just need to pay 420 ...moving forward with nvc and others i need to pay twice becumause its 2 person...just the filing fee of 420 will be the single payment...

Should i include the check for $420 with the form i130 and other documents in 1 envelop/folder?

When you file i130 for your wife, you will indicate your son as her child (which in effect a derivative). You only need to pay $420 as you are only filing one i130 form.

When you reach NVC process, you need to pay one AOS fee (am not sure if its still $80) as you will only issue one AOS (form i864 if i remember it right) that will already cover both of them.

But you will pay two visa application fee which is $365 ($365x2) as each of them is a visa applicant.

Hi! Badly needed your help.My husband is a permanent resident and he wants to petition me the soonest possible time because my son is 4y.o sick and has a cancer.He is an immigrant and just came in USA last month but sad to say I was not able to accompany him because My husband not yet petition me and my nonimmigrant visa was not approved.how can they expedite my case because my son badly needed me right now.I'm here in the Philippines. Yes. The only reason to petition them separately is if you might become a US citizen in the period of time before they immigrate. If you become a US citizen, then your wife is in the Immediate Relative category, which cannot have derivatives.

Yes, Make sure to carefully review the details you input in the i130.

Also, supporting documents to prove relationship should be included, marriage contract, birth certificate of the child showing the parents name, your proof of identity and permanent residency (green card). Double check these items from the i130 instruction that can be found in the USCIS website.

Not to over emphasize, read carefully the i130 instruction. All you need to know is detailed there. Where to send it, who to issue the payment to, etc..

You also need to include form G-325A in your petition. One for you and one for your spouse.

I am not an authority on this, but I have gone through the process of filing and all the information I needed to correctly file the petition were all taken from the USCIS website.

First time we've done this process was when my son filed a petition for me.

Then now the second time me filing a petition for my wife. We are on the same scenario where I filed for my wife and I have a 5 y/o daughter as a derivative.

Hi to all. Filled out petition I-130 for my wife - category F2A. I have a green card. For the moment i recieved form I-797 once that says petition is received and 2 months later i have received a second I-797 with information that all documents are sent to NVC. So, pls tell me what is the next step? Already passed 4 months without receiving any letter from NVC. Do i have to start preparing some other form or i have still to wait. Pls tell me. Thanks to everyone!
