It isn't that easy.In order for a US company to hire her on a work visa they have to prove that they cannot find a qualified US citizen to do the job. There are plenty of accountants in the US. US employers cannot just give jobs to foreigners

This is not so, to state the obvious there would be only a tiny fraction of the work visa issued if it was.

coming here for 3 weeks, then stepping back into Canada for a week, then making a U-turn for 3 weeks, etc, will last about 3 times, maybe 4, and then CPB will figure out she has no job and no reason to return other than these feeble attempts to fool the border folks, her visiting privileges will be rescinded and she won't be able to get a B2 if jobless, and it would still take a while to get one even if she goes back to work, because of the now exposed history of what all that funny business was about.

Canadians do not need a labor certification to work in the US and Americans do not need one to work in Canada. (As a NAFTA Professional) They basically show up and the border with an offer letter and a copy of their degree. I suspect the issue is that both the Montreal and Buffalo labor markets are not the best. I would consider moving to a 3rd location - Boston, Toronto or NYC seem logical.

Canadians do not need a labor certification to work in the US and Americans do not need one to work in Canada. (As a NAFTA Professional) They basically show up and the border with an offer letter and a copy of their degree. I suspect the issue is that both the Montreal and Buffalo labor markets are not the best. I would consider moving to a 3rd location - Boston, Toronto or NYC seem logical.

Sorry for the noob question, but when you say labor certification, are you referring to the TN visa?

A Labour Certification is an extensive, and unsuccessful, recruitment process in the domestic labor market prior to an employer being able to file a petition for a work visa. A Labour Certification is the main roadblock to hiring someone who doesn't already have work authorization.

It is required for most work permits; (H1-B) however, not TN.

I didn't read all the comments here so I apologize if I'm repeating, but just wanted to comment with my experience.

I am Canadian (now in the US) and my husband is the American, just like you guys. Last December I was able to take a leave from my job and come visit my boyfriend-now-husband for 2 months (which is a great "test" to see how things are when you live together). He proposed during these two months. We met with a lawyer during this time too, to see what our options were (not necessary, just use VJ!)

I also was able to do the same thing from June-September of this year, although we had already filed for the fiance visa in April. If you go the fiance route, your girlfriend is able to come on that visa and you have 90 days to get married-which should give you even more time, a month or two, to "decide" and get to know each other. although I don't recommend applying for the visa if you're not sure of course, lol.

My suggestion is that if she or you is able to get a smaller leave from work, instead of 6 months so she doesn't have to quit her job and you guys can decide what route you want to take. I hope that makes sense.

At first, I looked into the work visas and even talked to a lawyer who told me it's virtually impossible. I was not eligible for a TN visa though. When we first started this process I was kind of in the same boat as you -wanted to live together first. Instead, we planned the time to take longer visits, decided on the fiance visa (it's quicker that you guys can be together) before applying for it. You just kind of have to accept that if this is what you choose, everything is non traditional compared to other relationships lol! At first I had a hard time with it because I had always imagined my life being: living together, long engagement, getting married, blah blah blah.

Basically I think your smartest route (eventually) would be the fiance or marriage visas. That's just my opinion! Good luck to you! Feel free to message me if you have any questions. I hope you guys are able to figure it out soon! :)

Yes, she's an accountant and I'm glad you brought that up.

I run a side business, which is a e-commerce website. I'm currently a Sole-Proprietor. Is there anyway possible, that I can hire her as an accountant for my business and she would be offered a TN visa?
