Married in the Philippines, Divorced in USA, Can I be petitioned in US?

ok - so you've got loads of time (2 + years) to plan this out.

if i were in your exact shoes,

I'd live in another country on a work visa , have the f2-a visa interview in that country, and never return to the PI between 'interview date set' to 'greencard in hand' timeticks.

why? totally negates cfo involvement.

Yes, that is included in my plan too. Work in another country and have my interview there. :)

On a side note, A friend of mine married a Filipina years ago. They were both Filipino citizens at the time, and they married in the Philippines, so their marriage is on file with the PSA. They were later divorced in the U.S.

Fast forward to last year. My friend brought a Filipina to the U.S. on a fiancée visa. His fiancé didn't have any problem with the CFO despite the fact that my friend's marriage was on file with the PSA.

I realize this is not the same as your case, but I just wanted to point out that it works both ways.

I have the same problem too. My fiancee was married and divorced in japan to a japanese and she havent got the recognition of foreign divorce yet. We never got any rfe's from uscis. Her interview for k1 will be on the 23rd of december.. Her CENOMAR shows that she is still married to her ex husband. We are so worried about CFO they might turn her down because of her records in PI is still married.

Embassy won't be an issue as you have the divorce decree (translated). CFO is another story, they don't anything the same way each time.

This should not be a problem in getting a visa. Also, the CFO should accept your fiancee's divorce decree. I hope you will update us about what happens at the CFO.

CFO is our main concern. I hope everything turn okay at the CFO Councelling process. She is loaded with 2 kinds of divorce certificate the koseki tohon and the kyogi rikon with an english translation.. Whatever happens i will update our status for future references.. Thanks you VJ'ers!

It's good to now that your fiancee have been approved by USCIS and been scheduled for interview. I am also relieve that I am not alone on this kind of situation. Please share your experiences, especially the documents requested, so that I could prepare when my time comes. It's better coming from a first-hand experience.

Good luck to both of you! I hope she'll get her visa and be cleared by CFO. This will be a nice gift this Christmas. :)
