Queston 18a on I-864 - Federal income tax returns - for US?

Hi All,

I-864 question 18a asks " Have you filed a Federal income tax return for each of the three most recent tax years?"

Is that refering to US tax returns only? I'm a USC but have just moved back to the US - have been living in Canada for the past 25 years ...I have up to date Canadian tax returns ....Should I answer yes and attach my recent Canadian returns

The question does not specify what country for the Federal tax return...

12.15.2015 - Sent AOS pkg for spouse +2 kids to USCIS Chicago

12.17.2015 - Pkg received

12.22.2015 - Checks Cashed

12.24.2015 - 10 NOA texts and emails received

12.27.2015 - 10 NOA hard copies recieved via mail

01.26.2016 - Biometrics Appointment - FINALLY !!

02.10.2016 - Ready for I-485 Interview appointments

03-03-2016 - EAD approved- day 75

03-07-2016 - EAD/AP received in mail

12-28-2016 - Notice for interview

02-01-2017- Interview date

02--6-2017- Cards received by registered mail !!!

Timeline

Unless you have untaxable income such as social security and can prove you do not owe taxes, you were required as a USC to file and pay all withholding taxes quarterly estimated taxes on your earnings

and then to file the tax returns each spring

you will need to do your taxes

BTW if IRS audits and finds fault in any of the most recent years, they can go back to the first day you started working and ask for back taxes

This is how people end up owing so much even on a small income

So even though I have not lived or worked in the US they still require me to file each year??

Correct. US taxes citizens and Green Card holders on worldwide income. There are tax treaties that prevent double taxation, but if you've earned more than $10K (US) you should be filing US tax returns. So if you are the petitioner then you should prepare returns for at least 2013, 2014, 2015.

Also as stated, USCIS couldn't care less about your Canadian taxes. You needed to file your tax returns even if you did not live/make money in the US. Good luck! :)
