Hi,

I have a quick question: Can an F1 visa be rejected because I-130 petition was filed for me in F2A category - spouse of LPR?

My wife has a green card and currently we reside in the US. I am on E2 visa but it is about to be terminated. I am now looking for legal ways to stay in the country so that in half a year I can start the adjustment of status instead of consular processing from France.

I am considering to go back to France and apply for student F1 visa, but I am afraid it may be rejected due to the dual intent and filed I-130. Does anyone have experience with that?

Thoughts?

Thanks for your reply Piff. As soon as I filed for change of status to F-1 i can stay legally to the US? Also any info on where to start this process? I haven't done this before.

Change of status can be denied for immigrant intent just as visa or entry can be denied. Regardless of whether it will be denied or not, you are not supposed to either apply for change of status to F1 or enter the US on F1 visa if you have preconceived intent to file AOS during that status.
