Your name is in the system. yes they will ask you a little bit about why because they will see that maybe you are more about coming to the USA than the person you are coining here with. Just know that this will happen and think about how you will answer

This will not be over quickly. You will not enjoy this.

There is I believe no limit to the number of K1's you can have in progress.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

No one else files for a visa for you. Your current fiance(e) can file an I-129F petition for you. Once that is approved, you will be eligible to apply for your own K-1 visa at the consulate in your country.

All that said, the first petition should have been withdrawn in writing.

No problem

Well, given enough time, even an approved I-129F expires. From the sound of it, even if your ex-bf filed and got approved, it's probably already expired by now. So, I think you're in the clear.

I am hoping so..

First of all you are given a case number when the 129 is received at USCIS the first stage

When it goes to NVC it is assigned a new case number with the first 3 letters of your embassy initials for the system

you need to know these

and they are right it will not be over quickly / will look like you shop for visa

they will want to know how long you have known the new bf and if you were in contact with him while considering marriage to the first one

Good luck

Even though the previous petition has expired long ago we see posts with cases that are returned to USCIS because the petitioner did not withdraw it.

I hope the ex can give you in writing that it was cancelled so your new fiance can submit it with the new one.

Not requested routinely but to avoid potential future issues, it's best that way.

If you can't get any written proof then your new BF can submit a statement that the previous petition was withdrawn by -----on -------- with

all your relevant info and case number as an attachment or in the form of a relationship timeline letter. That way the CO will know before the interview

that your new BF knows about the previous petitioner.

These things can get hairy.

You are correct. The case number is assigned by NVC. What he probably used was your A#, which is assigned to you at NOA1. However a potential problem could be that he merely called. That is not the proper procedure to cancel a petition; sending a notarized letter to USCIS is the correct way to do it. That all being said, with the time that has lapsed, that first petition should have expired by now.

The thing is, my current bf wants to fiLe for a fiance visa for me on January2016 and I'm worried that my previous case wiLL affect our future apLication..

any answers wiLL be greatly appreciated..

Should have no concerns, let him file away.

As of Dec 7, 2009, now Zero miles apart (literally)!
