Hi everyone,

The next week i am going to send my petition for removal condition and I would like to see if any of you guys can help me with some things.

1. My evidence are:

4 bank accounts (2 chk and 2 sav) 2 statements from each year since I live in the US, I mean 2 statements from 2014 and 2 2015 of each account.

Lease of our apartment.

Lease agreement of our vehicle.

Vacation receipt in Mexico showing the hotel, the price we paid and the flights itinerary.

Joint filling tax returns 2013 and 2014.

Car insurance showing both names and we drive the same vehicle.

Copy of our passports and the stamps from Mexico.

Copy of our marriage certificate in Spanish but traduced and notarized in English.

Pictures from 2011 to present in different places and countries.

3 affidavits.

Copy of my resident card.

Do you think guys this is enough?

Do I need to send a copy of our driver license? Her license has the old address where she lived before I get to the US but mine has our current address.

The electrical bill is on her name only should I send it anyway just to confirm the address?

The phone bill is under her father name but she and I are in the same plan, is necessary to send it?

Another is OK using paper clips to separate sections or I need to use staples?

UPS or usps to send the package?

Thank you and I know is a long read, sorry :).

Not enough. Better to send monthly statements or at least quarterly ones.

Lease of our apartment.

Good.

Lease agreement of our vehicle.

Good.

Vacation receipt in Mexico showing the hotel, the price we paid and the flights itinerary.

OK.

Joint filling tax returns 2013 and 2014.

Send tax transcripts which can be ordered from IRS.gov for free and you should receive them within a week.

Car insurance showing both names and we drive the same vehicle.

Good.

Copy of our passports and the stamps from Mexico.

Not part of the ROC process. Omit.

Copy of our marriage certificate in Spanish but traduced and notarized in English.

Not part of the ROC process. Omit.

Pictures from 2011 to present in different places and countries.

OK.

3 affidavits.

OK.

Copy of my resident card.

Good.

Do you think guys this is enough?

Do you have joint credit cards, utilities, or health insurance?

Do I need to send a copy of our driver license?

No. Especially if it does not show joint residence.

Her license has the old address where she lived before I get to the US but mine has our current address.

The electrical bill is on her name only should I send it anyway just to confirm the address?

OK.

The phone bill is under her father name but she and I are in the same plan, is necessary to send it?

Why not have him write an affidavit attesting to that fact?

Another is OK using paper clips to separate sections or I need to use staples?

DO NOT STAPLE! The USCIS gods frown upon it.

UPS or usps to send the package?

USPS is fine. Get delivery confirmation so you can track it.

Thank you and I know is a long read, sorry :).

Good Luck! :)

Send at least quarterly statements from all joint accounts for the entire span of your marriage.

I believe the passport stamps from Mexico and marriage certificate were also to prove the vacation together and that you had another ceremony there? If you entered the US with a K-1, then your actual, legal marriage should have been in the US. I would just add the passport stamps for going to Mexico along with your other Mexican vacation documents.

I sent mine this week by usps priority mail, it had an estimated arrival date of today but it showing still in transit.... sending it at this time of year may cause a little delay I guess. No staples!, have everything sectioned and a cover letter explaining what each section includes. I sent the following:

  • Copies of both our driving licenses, front and back (shows same address)
  • Copy of front and back of residency card
  • Tax returns (transcripts) for 2013 and 2014 plus W2's
  • Every bank statement of our joint account (maybe I went into overkill sending every statement)
  • Copies of all tenancy agreements
  • Joint vet bills
  • joint water and sewage bill (all other utility bills will only have one name on account - annoying)
  • Online printout of my husbands capital one credit card account showing im an authorized user plus photocopies of our capital one cards
  • Joint car insurance
  • Joint car ownership
  • Life insurances polices on each other
  • Letters from our place of employment confirming each other being listed as the other persons emergency contact
  • 2 affidavits

I hope this gives you a few more ideas... your list holds the more important things.... lease, bank account, tax returns etc. You will be fine

Good Luck! :)

Thanks for the answer.

We dont have joint credit cards just savings and checking accounts ( i think this is enough ). No health insurance yet. The only utility is the electrical bill under her name, the rest is included in the lease.

Yes, is an excellent idea put him as affidavit, so would you recommend this and send the last or the two last bill of the phone anyway?.

what i have from the tax section is the papers that the place where i went to fill out my taxes give me, is Ok with that?

THANKS

We used USPS with "2 day Priority mail" but it has been 4 days and the tracking info hasn't been updated since the first day we sent it. If we only know that this would take this long, we could have just used air instead of ground mail. But I think it is still fine but will just delay the NOA1 a little bit. We also used paperclips.

The phone bill is under her father name but she and I are in the same plan, is necessary to send it? no

Another is OK using paper clips to separate sections or I need to use staples? paperclips

UPS or usps to send the package? USPS is a must. The delivery is to a PO box.

Same as us... we mailed ours off USPS priority which was due to arrive yesterday and tracking info has not been updated, just still in transit... we mailed ours on Tuesday. Please keep me updated as to when yours gets there safely.

We mailed it at the same day, on Tuesday. it was just updated to day and in transit. I also thought it was ground but my husband said it is air so it makes me more wonder why it took 4 days for the package to arrive in CA. Keep us updated as well. :)

someone told me usps can go by truck, train, air ..;. any which way LOL. Im praying its by ground and that's the reason its late. I was also wondering perhaps with it due to arrive on a weekend day.... maybe no-one was there to receive it hence no update? grasping at straws but the mere fact you sent yours the same day has lowered my anxiety somewhat and I think we were unfortunate that we needed to send it around the Christmas and busiest time of year. where do you live in relation to distance to California?

Lol, true. I had the wrong thought thinking it was ground but my husband said he paid for air. Mine just says it arrived in Anaheim today at 12:25am. They probably just scanned it in their receiving facility. We are from MN so it was understandable that it would take days if it was ground lol but it was air. I was gonna call USPS to ask how did the air with 2 day priority took 5 days to get to Anaheim when it shows that the package departed St. Paul on the same day which was on Tuesday. I will call them tomorrow to know more about it lol.
