Hi everyone, my fiancee arrived on a K-1 visa and I've been reading the instructions on how to apply for an AP. Here is what it says:

If you are in the U.S., you must attach:

A- a copy of any document issued to you by the USCIS showing your present status in the U.S., and...

B- An explanation or other evidence showing the circumstances that warrant issuance of an AP document; or

C- If you are an applicant for adjustment of status, a copy of the USCIS receipt as evidence that you filed the adjustment application

-Correct me if I'm wrong, but for part A, the I-94 should be sufficient right?

-And for part B, what other evidence are they looking for? Or what type of explanation?

-Finally, for part C, I'm assuming if my fiancee applies for the AOS and AP at the same time, she doesn't need to provide a copy of the USCIS receipt. Right?

Thanks for the clarification,

Lou

The AP application form is very confusing, I must agree.

For the reason you are requesting AP, you can give any reason you want. I have never heard of anyone having their AP denied. You can simply state it is for visiting elderly grandparents, other family members, to attend a wedding, funeral, birthday, etc. And even if you aren't sure of exact dates you wish to travel, just put any date down when you might anticipate travel.

If you have an emergent reason for travelling, such as a serious illness of a family member (like I did), you can get a letter faxed to you from the relative's doctor giving their prognosis, to send along with your application.

Good luck.

Thanks, but what about the other 2 questions I had. Is the I-94 sufficient for part A, and do I need to provide a receipt of my AOS application for part C? Thanks

lou,

You are correct about parts A and C. For part B, note the little tiny 2-letter word at the end.
