IR1 DCF Rejected at Interview due to Affidavit

Hi,

My husband had his interview at the US Embassy in London and his application was rejected. We had a complete affidavit of support from my Father (with all supporting docs), but the office told my husband that I had to send one in (as the sponsor) which they would need to reject before the could accept my father as a sponsor.

I did not realize that I had to do this, I thought having my father as the sponsor was sufficient, and it seems kind of silly for me to fill out that form when I clearly am unable to sponsor just for it to be rejected. Anyway, I have filled out the affidavit which indicates that I do not have the means to sponsor my husband, but I do not have any tax records to support this.

We want them to reject my application so they can accept my father as the sponsor, but is not providing all the supplemental documents going to cause a problem? We have submitted it and we are waiting to hear, but just curious if anyone else has had this problem.

Petition posted~ July 7 2015
NOA1 received ~ July 9 2015
Petition approved ~ Aug 20 2015
NOA2 received ~ Sept 20 2015
Packet 3 - Never arrived, emailed embassy after 8 weeks had passed, was given a case number and informed that a letter was sent on Sept 23rd which we never received. We confirmed our mailing address, which was correct. Unclear what the issue was.

Medical completed ~Nov 20 2015 All clear pending blood results.
Packet 4 - Not received, emailed embassy and was given interview date and link to documents required.
Interview ~ Scheduled for Dec 2, 2015!

Yeah the petitioner is always the primary sponsor, and they will come after you first, should your husband avail of means tested benefits. Your I-864 will NOT be rejected, it still counts, you will just need a second one from the co-sponsor.

Why do you not have tax documents? if you worked abroad, you need to back file and provide them. If you did not work at all/ had no income at all, provide a written statement as to why.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks. I am currently in the process of back filing taxes from living abroad via the Streamlined Program. This is all paper, so I don't get any kind of receipt.

So I can assume that the Embassy is going to ask me for more information, as I did not provide a letter of explanation (the way it was explained to my husband, it seemed like they wanted to reject it).

What is the best documentation to send to the embassy? Should I send a letter of explantation stating that I am filing back taxes due to misunderstanding of the tax law and a copy of what I am sending to the IRS?

Just wanted to update this.

I submitted the affadavif without any tax info or even income info, and our application was accepted. I think they just wanted my signature on that document to assume financial responsibility should need be.

Timeline

Whether you have any income, tax information or not, you or the primary sponsor needs to fill out the I-864 form. If they accepted your form, I assume everything's fine. But always check with them to make sure.
