Hi everyone,

We are about to file for AOS. However, I am having a little bit confusion here.

For Affidavit of Support (i864)

The household size is 2 : USC (sponsor) and the foregin spouse (immigrant)

The sponsor makes highly above the 125% federal minimum income requirement.

Instructions for i864 says :

Item Number 2. Current Individual Annual Income. Enter your current, individual, earned or retirement, annual income that you are using to meet the requirements of this affidavit and indicate the total in the space provided. You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual salary. You may also provide pay stubs showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income.

If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income

Our situation:

We have the last 3 years' IRS trancripts (2014,2013,2012)

Paycheck stubs for the recent company

Letter from the current employer

Our problem:

For valid reasons, the current job is the sponspor's 3rd job for the last two years. Therefore, obtaining W2's are not an easy job. Do we really need W2s ? or IRS transcripts are enough since the income for the last three years is already above the required level?

You have the option of providing either (1) Entire federal tax return + W2 or (2) IRS Tax Transcript.

Since you'll be providing the IRS tax transcript, you don't need to worry about W2s.

At the interview, I showed my IO the W2s and IRS Transcripts - he took IRS Transcripts & told me he doesn't need the taxes. So yes, either one works.

AOS i-130, i-485 & i-765 in New York (Queens field office)

12/29/2014 - Priority Date; receipt number starting with MSC

1/2/2015 - Fingerprint fee accepted

1/26/2015 - Case suspended - RFE sent out

2/3/2015 - Fingerprint done at Jamaica Center, Queens

2/11/2015 - RFE received - Case resumed

3/2/2015 - EAD ordered

3/13/2015- EAD card mailed out -- received it 3 days later

7/8/2015 - AOS interview ready to be scheduled for an interview

9/27/2015 - AOS Interview scheduled for Nov 3

11/3/2015 - AOS interview

12/11/2015 - APPROVED!!!

ROC (Vermont Service Center)

10/3/2017 - Sent out ROC package to VSC

10/6/2017 - Date on NOA (Received NOA on 10/16/2017)

11/6/2017 - Biometrics done

8/15/2018 - Extension letter for 18 months received

12/28/2018 - APPROVED! (No RFE, No Interview) 🤸‍♀️ 

1/7/2019 - GC delivered

N-400 (Queens field office)

1/22/2019 - N400 delivered to Dallas, TX.

1/25/2019 - Check cashed

2/12/2019 - Biometrics appt

8/26/2019 - Interview scheduled

10/3/2019 - Interview - APPROVED

10/30/2019 - Oath

Timeline

When using IRS transcripts, there is no need to also include W-2s. You don't have to worry bout obtaining W-2s.
