i submitted my wifes I-485, I-765, I-864, and the medical I-693, after receiveng the approval of the i330, my question is; the i-693 package was filled by the medical dr but they put in my last name instead of my wifes last name, eventhough she wants to take my last name, but all of the other paperwork states her last name.....

will this be an issues or will it cause the package to be returned to me?

It shouldn't be because she'll be taking your last name -- although you should've put your last name on the I485 if she wanted her green card issued with your last name.

If approved, it'll come in her maiden name and then you'll need to complete another form to receive a new one.

You needed to fill out all the AOS forms in her new married name, if that is what she wants her name to be after marriage.

You can try making an infopass appointment and seeing if they can change her name in the system to her married name, if that is what she wants her EAD/AP and green card to come with. Filing to change the name on the green card after the fact is pricey and takes months.

If you submitted your i-485 already, you submitted your marriage license too, and it seems like your wife kept her last name on the marriage license, right? (whatever appears on the marriage license is the legal last name for now)

If that is the case, you can get an RFE (to submit the correct form, but I never saw that happen). If you don't get any RFE, when you have your interview, you just need to let the IO that there was a mistake, and that's it. :joy:

You send a copy of the marriage certificate, not license. Also, it is not true that whatever is listed on the marriage certificate is the current legal name. Many states do not list the name you choose to use after marriage, but it still acts as your legal name change document for changing your name through marriage.

AND, it appears the OP meant they had an approved I-130, so it seems they are not adjusting from a family based visa and can ask to have the name changed on the green card at the interview because they will definitely have one.
