We filed our AOS based on a K-1 visa over 14 months ago and still have not received a green card. Is this unusual? Abbreviated timeline:

Sept. 22, 2014: AOS received notice (I-797)

Dec. 30, 2014: Notice of potential interview waiver

Oct. 1, 2015: Submitted case inquiry (case status website) for 'case outside normal processing times'. Automated reply stated they would get back to us in three weeks... they did not

Nov 2, 2015: 2nd case inquiry. No reply.

-No RFEs-

Phone calls just get us 'Your case is in Missouri (National Benefits Center) and that's all we can tell you at this time'.

In the meantime my wife's EAD expired on Nov. 21st. She will soon be let go. We applied for a renewal on Oct 5 (I know, I know, we waited too long but we couldn't believe the green card would take this much time) but of course that hasn't come through either.

Is/was anyone else in a similar situation?

To say the least we are a bit frustrated.

Contacted our senator (Jon Tester) last week. His office called about 30 minutes ago to say they are still looking into it.

My wife called the National Customer Service Center (again) this morning and they said they would get back to us within 15 days. Can't help but feel a little cynical about this claim after their failure to get back to us twice before...

We will definitely try the infopass route if we hear nothing in the next couple weeks. I was mistakenly under the impression that infopass was more for emergency type situations.

Yea... I have noticed when your case has a potential interview waiver, they take longer to process but usually it takes less than 5 months from getting the waiver, not a year. Where are you filling from?

1/26/2015 - Case suspended - RFE sent out

2/3/2015 - Fingerprint done at Jamaica Center, Queens

3/13/2015- EAD card mailed out -- received it 3 days later

7/8/2015 - AOS interview ready to be scheduled for an interview

9/27/2015 - AOS Interview scheduled for Nov 3

12/11/2015 - APPROVED!!!

A bunch of people who applied for AOS when I did had interview waivers and most of them took more than 12 months. In the end they had to contact the ombudsman to get a resolution.

15 months for me :( After 12 months of waiting the congressman's office was involved. Numerous infopasses were not helpful at all. The same with National Customer Service Center. Even when the congressman figured out the case was transferred to different USCIS Office they still kept saying my case was in Missouri.

All the adjustment of status applications are first sent to the USCIS in Missouri to be reviewed. This office determines if the case will be waived for an interview. They have been backlogged in the past year, so to help process the cases faster, they started sending cases to other USCIS offices to help review the case. So I doubt your case is still "sitting" in Missouri... Hope your senator will help to move your case on.
