My mom filed i130 for me about a year ago, on September 11 my priority date became current. When I called visa centre a week ago they said that on October 28 they took my case to calculate my CPA age. It's been almost 3 month since my priority date became current and no-one can tell me when am I suppose to get an invitation letter with instruction to file I 485. Have anyone been in the same situation or have any idea how long it's gonna take for them to calculate my CPA age and send me that letter?

we need more information, is your mom a USC or LPR? how old are you and from what country are you from?

where are you in your country or here in the US? if you are here, are you legally In the country?

My mother is a Green Card holder. I have already turned 21, but my CPA age shows that I am still 20 years and 9 month old. Currently I am in the United state under F1 student status.

hi

no one will send you anything, the National Visa Center deals with cases that go through consular processing in their country of origin

if you qualify to adjust status in the US, you file the adjustment of status packet and have the interview here instead of your country

what is your priority date? because I checked September's visa bulletin and immigration was working with March priority dates and you state that your mom filed for you a year ago

so what is your actual priority date?

no one will send you anything, the National Visa Center deals with cases that go through consular processing in their country of origin

if you qualify to adjust status in the US, you file the adjustment of status packet and have the interview here instead of your country

The priority date is January 30, 2015

But I definitely remember them saying that I am suppose to get a letter.

Can you suggest me something?

immigration is working with 2014, not 2015, the wait for a child under 21 of a LPR is almost 2 years to 2 years

have you checked the current visa bulletin?

unless you wrote the date wrong and it is January 2014 and not 2015?

the people you spoke with have no clue, you don't get a letter when you adjust status in the US

No, i did not mistake the date. It is January 2015.

I know that the visa bulletin shows 2014, but there is another chart below which shows the priority day March 2015 and I was assured that that my priority date become current by that second chart

no, the priority date is based on the first chart, the F2A category takes around 2 years to process

the second chart is for the NVC, for consular processing, the NVC can start to request paperwork if they desire, before the priority date becomes current, instead of waiting after your priority date becomes current

so they can start requesting the petitioner, payments, forms and documents and then the interview would be scheduled when the priority date is current

but to adjust status in the US you would have to be legal all the time and send your adjustment of status packet based on the first chart, if you send it sooner, they will return the packet with a letter stating that your priority date isn't current

so by 2017 you probably will have aged out, and be transferred to the category F2B, which has a long wait, 7 or more years depending on your country of origin

I still do not understand. I called NVC 3 times and 3 different people told me the same story that on September 11 my priority date became current and they took my case to check on my CPA age. They also told me that September 11 will be considered as a date for the CPA age. I understand that I will be able to get the green card after my priority day becomes current or is earlier than the cut-off date in the AFAD chart, but as I understood from this website (http://dyanwilliamslaw.com/2015/11/changes-to-the-visa-bulletin-understanding-the-two-filing-charts/) I am able to file I 485 as well as to file for the employment authorization, get a travel document and wait until my priority date becomes current in the AFAD chart.

​Please correct me if I am wrong.

you are wrong

the NVC has nothing to do with adjusting status in the US, consular processing is different and they are wrong, your priority date isn't current

you may be able to start sending paperwork for consular processing prior to your priority date for consular processing, but the chart you should always be looking at is the first one, that's the one that states there is a visa available for you

when you adjust in the US you cannot send your packet and wait until your priority date is current, your priority date has to be current to send the packet or they will return your packet and based on the first chart, your priority date isn't current

Actually, since October, USCIS has been noting on each VB whether or not, applicant can file for adjustment of status based on an approved petition.

Since OP has a PD of Jan 2015, it looks like they can go ahead and file for AOS.

New Visa Bulletin Charts

The Visa Bulletin will now have two different charts because of the revised procedures. DOS will post two charts per visa preference category in the DOS Visa Bulletin. The charts are:

  • Application Final Action Dates (dates when visas may finally be issued); and
  • Dates for Filing Applications (earliest dates when applicants may be able to apply).

When USCIS determines there are immigrant visas available for the filing of additional adjustment of status applications, the Dates for Filing Applications chart may be used to determine when to file an adjustment of status application with USCIS. Otherwise, the Application Final Action Dates chart must be used to determine when to file an adjustment of status application with USCIS.

In coordination with the DOS, USCIS will monitor visa numbers each month and post the relevant chart on this page under When to File.
