i won the dv lottery ,got the visa but never left to the states

I believe the DV visas need to be issued before the end of the fiscal year -- which would be September 30, 2015.

You may have been able to request the embassy to reissue your visa before the FY end by stating personal issues but, they are now in the new FY with new DV number limits.

Unfortunately, it seems at this point, you'll need to re-enter the DV lottery.

Yes . Usually it's six but I did my interview really late. That's why I got only one month.

This doesn't make sense. Even if you do the interview late the expiry doesn't depend on when you became current initially. Did you do your medical very early before the interview, that's the only thing that could explain that?

In any case if you got your visa in July then you would have been DV2015, the DV2015 fiscal year is over and no more visas can be issued for that (they usually won't re-issue DV visas in cases like this anyway). As another poster said, your only chance is to enter again...next one open in October 2016.

By law, a diversity visa must be used by the end of the fiscal year in which the entrant won; that date is 30th September in any given year. If you haven't either used your visa to enter the US, or had your AoS approved if you were already in the US and simply filed for adjustment instead, you forfeit your right to live in the US.

That quote is actually partly wrong and misleading - it shouldn't be used as a reference.

The end of the FY has no bearing on when a DV based IV must be used. The visa only has to be ISSUED before the end of the applicable FY. The visa can be used months after the applicable FY has ended as long as the visa itself hasn't expired.

MR. WILCOCK: Six months maximum. All immigrant – that’s the maximum validity of the immigrant visa. So the last visas for DV-2012 will be issued at midnight September 30 on 2012. But the visas can be used up to the dates that they expire, so there are going to be people from DV-2012 who will be entering the States into 2013, the first couple of months, because the visa has a six-month validity – maximum of six months. It can vary from applicant to applicant. But you have up until the maximum validity to actually enter the United States. It doesn’t have to be at the end of the program year.

OP, it is unlikely, you will be issued a new visa.

You should have contacted the embassy when you realized you couldn't travel within the time given.

You sat there and did nothing.

You had an opportunity and you didn't take it.

But you can give it a shot. I personally know someone who just left things like you did and had to play the lottery again. Unfortunately, he hasn't won again.

My understanding is that there can be no extension of the date by which you must activate your visa. If you don't make it into the USA by the date on your passport, you've forfeited your visa.

Your only option now is to try and win again.

SusieQQQ, until you have seen or heard all scenarios and circumstances, you can never say , it is impossible!

No law is absolute. Until a law lists all the possible clauses or precise definitions, it is possible for someone to get through a loophole.
