k2 Visa not eligible for SSN

Hello VJ family,

so yesterday, I was very very busy. I had to go to customs border protection to have them fix my husband and step son I94... should be in the system today, I also went to get their SSN and change my last name. Well I was surprised to find out that his son is not eligible for a SSN until he gets permanent residency. This is crazy and I have been there before and this was never even mentioned. In any case they say for tax purposes the IRS can assign a ITIN number but until he gets a work permit(seriously, he is disabled and will never work) he can not get a SSN. Luckily, My husband was able to get his SSN labeled as non immigrant allowed to work? Does this mean he can seek employment before he gets his work permit? or do we still have to wait on the AOS process.

You still have to wait till he gets his EAD card. And it is true about kids (K-2) not being able to get their SSN number til they receive their EAD card. Sorry

The SS card should state "Valid for work only with DHS Authorization" ... That basically means he can work with the proper EAD card to go along with his social security card.

K-1, K-2, K-3, and K-4 (if the OP's husband is K-3, then their stepson would be K-4) can apply for EADs, and after getting EADs they can apply for SSNs. Only K-1 is able to apply for SSN before getting EAD. However, getting an EAD based on K status is a big waste of money because once you file AOS, you can get EAD based on AOS for free.

I am unable to file for both at this time financially. I would if I could afford it. I know it is a 400 discount but at this time struggling. had to make an extra unplanned trip to Jamaica for my second interview and frankly that took the rest of my resources for this. But appreciate your response

Everything is going as planned, I'm guessing. I haven't heard anything since I filed on the 1st of October. According to my timeline I should get something in the next week or so.

Did he get his SS card on site? When we went they put it in the system and gave us a letter stating we should receive it in about 6 weeks. On the letter it did say that the Social Security card was for work purposes only. But if you got it on site at the social security office they probably worded it differently.

Yep, AOS is not cheap. When my wife and stepson went through it, I had to fork over $2140. This whole immigration process is not for the faint of heart, nor light of wallet..... :rofl:

No he didn't get it onsite. He got a letter just as I got a letter to change my name. When they had him verify the info on the confirmation page, I just read that it said non immigrant authorized to work. Then after he read it and said all was ok, they gave him a letter saying he applied and that it should come in the mail in 2 weeks. I do however understand that he would need his EAP to work now. I was just being hopeful:)
