Hello All,

I am new to the forum and think this is an excellent communit full of helpful people. A little bit about me I am Hispanic born in Mexico i was brought here when i was 7 years old and entered the country legally trough a visitor visa. I met my wife in high school when i was 16 and married her 4 years later. Now we have a one year old and have our own home. I became DACA approved when the law was first passed and currently I am trying to file for a Green Card trough marriage. I do not have any criminal priors, so that is not an issue. I am still unsure about the paper work to file, so far the paperwork i have prepared is as follows:

I-130 Petition for Alien Relative

G-325 one for myself and one for my wife

I-485 Application to Register Permanent Residence or Adjust Status

I had no problem with the following documents but the ones that i cannot get my head around is the Affidavit of support of course i know that my wife has to fill one out, but she has not worked in over a year and therefore does not meet the requirements. My father in law is going to fill one out for me to fulfill the poverty requirments but he does not make enough on his own and needs to add his wifes income to it. I have been researching and came across that i need to fill out two I-864 Affidavit of Support one for my father in law and one for my wife. and then my mother in law has to fill out the I-864A. Can anyone help me?

hi

yes, that's correct

your wife as your sponsor, has to file the i864 regardless of what income she makes and attach a letter explaining why isn't she required to file taxes

her father will file an i864 as her joint sponsor, and his wife will file the i864A as his household member
