K-1, married, just sent off AOS

Hi everyone

We sent off our AOS packet today.

My husband Josh and I got married on 10/18/2015. I moved to North Carolina in June 2015 and my husband joined me August 2015. We were able to have Josh take a drivers license test and get his permit here in North Carolina. But it expired mid November when his electronic 1-94 expired.

We've just sent off our AOS package today. When can he go take his drivers license test? When we get a receipt for our AOS package? Or do we have to wait longer or for certain documents or approval... thank you!!

My brother in law is in NC and he just got his drivers license from a learners permit. When you get the NOA, you can renew your husband's permit to a drivers license:

Proof of Legal Presence in the U.S.

Listed below are acceptable documents you can use for a non U.S. Citizen:

• I-551 Permanent Resident Card
• Machine Readable Immigrant visa
• I-766 Employment Authorization Card
• Temporary I-551 stamp on I-94 or Passport
• I-327 Re-entry Permit with supporting immigration documentation
• I-94 Arrival/Departure Record
• I-20 accompanied by I-94
• DS-2019 accompanied by I-94
• I-571 Refugee Travel Document with supporting immigration documentation
• I-797 Notice of Action
• I-521L Authorization for Parole of an Alien into U.S. with supporting immigration documentation
• I-220B Order of supervision with supporting immigration documentation

You might be able to finagle it with an I-797C receipt notice for his I-485, but most states need to see at least an EAD to pass their legal presence test, if they have one.

The above states I-797, which is an approval notice (or denial notice, I guess). An I-797 is not the same thing as an I-797C.
