Timeline

I have seen a lot of activity on the site about other countries and DCF filing but I have not seen a lot about this for Japan. Does anyone have any new information on the possibility of filing in Japan?

Are there any indications of them going back to the way they use to do it?

I was going to file in Japan in April, even though I am not a citizen, because this was allowed before the change in the law. Does anyone know if I can still do that? What USCIS office would they send the I-130 to?

This is getting very frustrating, to say the least but I am glad that others are finally getting their situation corrected.

Our instructions in Japan are to file the I-130 at the California USCIS. Japan is under Seoul USCIS, but we are not to send our petitions there. I wish we could, but that's the way it is for now.

01/31/07 - I-130 fedexed to California

02/01/07 - I-130 received by USCIS California

02/13/07 - received NOA1

04/10/07 - Petition approved (64 days)

04/17/07 - Received NOA2, petition on it's way to NVC

05/07/07 - Still nothing from NVC (those bums!)

04/05/07 - Re-filed I-130 at Tokyo embassy with no problems! (didn't need to canx first petition)

04/12/07 - Petition at embassy is approved (7 days!)

04/16/07 - Received notice of approval from embassy, submitted interview request

04/17/07 - Received notice of interview, which will be May 7

05/07/07 - Had interview at embassy, visa approved!

05/08/07 - Passport with visa delivered!!!!

Dang, the Tokyo embassy is fast!

Hello

I guess petitioners living in Japan, like petitioners in Singapore cant proceed with DCF as yet. Like the Seoul USCIS office, Bangkok USCIS isnt accepting the I-130 forms from US citizens living outside Thailand. Our option as of now is to send the forms to the US. However, I have been told several times that they expect DCF to return. When? They do not know. They said it could be a max 6 mths wait and they did suggest that I wait a little if I am in no hurry to get this process done.

This is very frustrating. If American Immigration had planned for this a little better, we would not be in this situation. With USCIS offices overseas it would have been natural to send the I-130’s filled to one of those. Why California? It makes no sense. They really need to get this worked out for us that are caught in the middle.

Maybe they will clarify this soon so that by April I can file in Japan. I do not look forward to filing in the US with their tendency to take forever to get things done. Has to happen soon or I will not be able to get an appointment.

Yes, it is frustrating. The only logical reason I can think of as to why Seoul or Bangkok USCIS is not taking our petitions is that maybe they are under-staffed or ill-equipped to handle the increased load. The petitions that the Tokyo embassy received between last July and this January and were still pending have been sent by the embassy staff to either Bangkok or Seoul for re-adjudication (along with petitions from other area embassies/consulates), so that may have maxed them out. After the workload is caught up, DCF may come back. But who knows when that will be, if ever. I decided not to wait and went ahead and filed at USCIS in California.

The way the USCIS is talking it does not appear that any adjucations of I-130's will be taking place at Embassies now or in the future, but will be taking place at USCIS offices abroad. What may happen is that the I-130 can be accepted and paid for at an Embassy, but the Embassy will then forward the petition to the appropriate USCIS office for adjudication.

That being said, it appears that the USCIS office in Seoul is not accepting I-130's from those resident abroad at this time. So you have a choice, you can file the I-130 now in the US.. or you can wait some indeterminate time to file at either Tokyo or Seoul when they decide the time is right to start accpeting them again...

To be able to take advantage of DCF I would have to file during my visit in April. If I do not hear anything about being able to file before then I will have to file in America when I get back.

It is just my luck that this happens now. If I were getting married last year at this time my fiancé and I would not have this problem.

Does anyone know how long it takes in America when you file there? Since my permanent residence is in Tennessee I have to file in Texas; but I have heard that Texas is no longer accepting I-130’s. Where do we file now?

To be able to take advantage of DCF I would have to file during my visit in April. If I do not hear anything about being able to file before then I will have to file in America when I get back.

It is just my luck that this happens now. If I were getting married last year at this time my fiancé and I would not have this problem.

Does anyone know how long it takes in America when you file there? Since my permanent residence is in Tennessee I have to file in Texas; but I have heard that Texas is no longer accepting I-130’s. Where do we file now?

If I were you I would go ahead an file in Texas because even if DCF comes back it seems as if theyre gonna have stricter requirements with regards to residency. It seems from what the other have said that Tokyo already had a pretty strict residency requirement anyhow.

dbzman was either mis-informed or mis-understood what he was told.

The TSC (and the NSC) are still accepting I-130s, they just aren't processing them. They get sent to the CSC for processing.

I believe that, unless something changes soon, I will have to file in the US. My future wife and I have not issues that would cause any delay so maybe the process will not be too long.

This process seems to have been difficult in the past; but is much more difficult now that they are changing things.

Maybe Im confusing the Tokyo with another embassy. Regardless. It seems as if theyre gonna be tighter if/when DCF comes back. . . .thats not my opinion its just what Ive heard others saying.

Tokyo or any other consulate is not accpeting I-130's from anyone as they are no longer authorized to accept them... Only USCIS offices abroad are...

USCIS has established a policy that the onmly individuals who are permitted to file an I-130 at a USCIS office abroad are those who are resident in their country and have the authroized paperwork to prove their residency. Being able to file an I-130 abroad as a visitor is now a thing of the past and will not be coming back... ever...

So if you live in the US, go ahead and file in the US, because that's the only thing you're going to be allowed to do...
