Obtaining NBI if some past history

Does anyone know what happens if someone applies for NBI document and they find some old cases where a lender had pressed charges for bad checks?

In some cases the case has already been settled by judge and payments are being made but in one case it may still be open or in archive status. will NBI just inform the person that there are problems or will that person be putting themselves in danger of being pursued by police? I guess I am asking if there is a way to know if you have clearance before applying and does applying put you in jeopardy with NBI if they find something? I was told by one lawyer that it is civil and not criminal but at the same time he is telling me we need to pay him 150k so that he can get the clearance. 50k for each old case. I think he is scamming and would like to just try and get the NBI ourselves. Dont want to risk getting my handcuffed when she goes in for the document

Thanks Hank, but I have read this before. Not sure if it answers my question. I understand that it is required. what I don't understand is what happens during the request process when the y may discover something.

That is why I highlighted the one sentence. If during the interview the CO sees - any notation of “No criminal record” or "No pending case the CO will then ask for a letter of explanation from NBI, you will receive a 221g email which you take to NBI they will most likely interview you at some point then send the explanation letter to the embassy. How the embassy responds to this depends on the letter.
