We filed for AOS, EAD and AP at the same time. Foolishly. Shouldn't have bothered with EAD and AP as it seems AOS approval is imminent....

Interestingly, though.... there have been several touches to the AOS, and NONE to the EAD and AP.... wondering if the adjudicators for the EAD and AP see the progress on the AOS and are ignoring those applications....

Anyone else have the same thing happen?

It does seem that these days, the AOS is being approved very close to the EAD and AP, which makes filing the EAD and AP sometimes unnecessary. If you do not have to work immediately, and have no plans to travel immediately, the AOS is probably enough.

It wasn't that way when I applied for my AOS/EAD/AP. They usually approved the EAD first, then the AP, and then the AOS quite a while later, so it made it more worthwhile to apply for EAD and AP.

If I were doing it now, I doubt I would bother applying for EAD/AP.

Good luck for a speedy approval.

Agreed; as approvals are happening virtually simultaneous for all. For those of you about to file AOS, save your money and refrain from filing EAD and AP.

I agree with Meow Mix. This process is still a ####### shoot, so it is almost a 'safety net' to apply for the EAD and AP. Just thinking of it as paying more for a quicker processing of your gc if you want to.

The advice is clear as presented both by myself and raymaga in that; for those who neither have need to travel nor quickly work, then filing for EAD and AP is a moot point. If on the other hand you suspect that your AOS is not a cut and dry issue as many marriage based ones are, then, pay the extra dollars and go that route.

Again, your calling crappy advice carries little weight as you've failed to look at the evidence and statistics of this board. Many indeed are receiving their EAD and AP approvals within a few weeks of AOS approval.

It seems that most of the first time AOS filers are receiving pretty quick approval. Why some applications take much longer probably has more to do with their original entry, than the actual filing of AOS. If you came on a K-1/K-2, then the processing seems to be much quicker. Without seeing the USCIS statistics for when people apply for AOS after legally arriving in America, it seems that filing soon after satisfying your visa requirements greatly improves your chances of a faster approval.

Remember that this forum is for all people filing for adjustment of status. So the situations are different for many here. If you are recently here under a fiancee visa, get married in 90 days and apply soon afterwards, then you can probably forgo the EAD and AP. But, if there is a problem, then the safe way would be to apply for EAD and/or AP.

I can tell you that last year we applied for AOS, EAD and AP all at the same time, within 30 days of our marriage. My wife received her EAD and AP three weeks before the AOS appointment and the green card arrived 10 days after that appointment.

Use your own judgment in all cases.

What is your definition of 'quickly'? Because if you get held up in name check it can take months - years even for some. And yes - even if you have a cut and dry case. Not applying for EAD and/or AP is a gamble; each person needs to decide for him/herself if the game is worth it - or even affordable. Telling someone to gamble with their finances is surely inadvisable. We live in a 'what if' world. What if you get held up in name check? Can you afford not to work for months and months or years?

Your point will also be a moot point in October, when the increased AOS fee will include EAD and AP.

I know of no one who received their AOS approval within weeks. it will take at least a month or two if one is lucky (from the time application is filed till interview is scheduled). Even still, not everyone who gets their interview scheduled quickly is guaranteed to have their AOS accepted for there some people who do not clear the FBI name check by the time they have their interview and they end up having to wait for months before their AOS gets approved.

Do not take it personally when the other person said that it was a crappy advice, but it really was not a good advice since your post made it sound as if the majority of people get approved in weeks, which is never the case.

even the original poster here has applied for AOS and it has been over a month. and they still have not been approved.

Yes Mo, it includes taking a chance indeed. In the last few months the evidence shows that the vast majority of marrige-based visa holders are receving their AP and EAD within a FEW WEEKS before their AOS is approved. I and many others accepted the gamble and things worked out just fine. Additionally, many AOS applications are now being approved without an interview, which further decreases wait times.

My apologies to those of you that have been waiting ridiculous amounts of time for what most of us would deem a cut and dry case. Do not confuse the suggestions here as a slight to those waiting for long periods of time, as in years. Most members of this site however are receiving AOS approvals within one year of filing however, many within six months.

VJ is a microcosm representation of immigration.

Even in that case, I would say there is no evidence on this board of the 'vast majority' of marriage based petitions receiving EAD and AP just a few weeks before AOS. It's also wishful thinking to say 'many' cases are being approved without an interview. It's more correct to say 'some'.

In fact, what I am seeing is more people cropping saying "we were interviewed months ago, just found this community, and are caught in namecheck".

I'm also reading posts claiming a successful interview except "our officer told us all we have to wait for is the namecheck" - such posters obviously not even realizing what that entails.

It's also PATENTLY FALSE that a case being 'straightforward' speeds up AOS. This isn't the visa process - it's strictly a pipeline system. The 'speed' depends on which district office you have and whether or not your NAME sounds like or is the same as someone on an FBI list. Nothing more - nothing less.

Frankly, I'm starting to take offense to claims of straightforward cases speeding up the process. It's an insulting statement.

If I were doing it now, I doubt I would bother applying for EAD/AP.

Things must really be changing then. We didn't apply for any AP but decided to get an EAD for my stepson and wait for the AOS for my wife. As it turned out, I had to renew my stepson's EAD after it expired in one year and we regretted not getting one for my wife because we waited two years for the AOS.

I think it is up to every individual whether they apply for EAD and AP additionally to AOS. Even if it might not take a long time right now for an AOS approval, you can never know.

I filed for EAD and AOS but not the AP because I didn't have any travel plans, and actually I regret it, but I still have the option to apply for it if plans should change.

So, my advice is, if you want to save some money and you don't HAVE to work or you don't plan to travel, wait a while with filing for EAD and AP, but I have to say, I am glad I at least got my EAD card, even it was expensive.

At least now I can get my drivers license!;-)

Hey Jen! First of all Congratulations on your marriage! I haven't been on this website for months dur to my very hectic school schedule. I hope all is well with you and your husband! We didn't send out an AP but our EAD was never touched before we got our AOS approval. I was starting to get worried but there was no need because CSC is wonderful and you should have your AOS approved very soon! I think that they may know how far along a case is coming and just stick to approving EADs that aren't transferred or that they know are going to be a while for AOS. Well I hope to have alittle more time to see how things are goin here in the world of VJ! Talk to ya soon and good luck!
