Hello All,

We are about to file 1-751 and i had couple questions.

1) When this can be filed. i think I read about 90 days but we don't have all the papers yet, waiting from couple things from insurence comapny to send us. Can this be filed later but before the GC expires like 60 days before it expires.

2) Which forms I will have to send.

You can file the I-751 90 days before the GC expires (the expiry date is on the GC). You will then receive an NOA which extends your conditional resident status for one year (with employment and travel authorization).

You will need that NOA if you travel outside the U.S. for your re-entry into the U.S. to show that you are not out of status and that you have applied for removal of conditions.

You don't have to apply exactly 90 days before, but you should try to send in the I-751 as soon as possible after the 90 days to make sure you get the NOA extending your conditional resident status, before the GC actually expires.

As far as what you need to send with the I-751, the instructions give very clear directions.

The window for filing opens 90 days before GC expiration, and closes on the date of GC expiration. You can file at any time during this window. 60 days before GC expiration would fall within the window, and so would be fine. Most people recommend filing nearly as early as practical, to get it over with and to give you some time to recover from unforseen circumstances, but the only deadline as far as the USCIS is concerned is the GC expiration date (even that deadline isn't always firmly cast in concrete, but don't wait and test it).

2) Which forms I will have to send.

The I-751 is the only official form that they need for removal of conditions. Evidence will be attached, but that doesn't need a form.
