Hi,

I have some questions about additional documentations for the I-485. I've been arrested once in the past and acquitted later on. I have all the documentation related to my arrest + translation. Should I write a letter to explain what happened? I wrote one for now, it's pretty short and just say when I was arrested, why, and that I was acquitted.

For the I-864, my wife doesn't meet the financial requirements (she doesn't have 3 years of tax returns). Should I join a letter explaining why she never filed her tax returns? Also what papers does the co-sponsor need? I have 3 months pay stubs, 3 W-2, letter of employment, copy of passport, is that enough? If he is single with no child, the household size is 2? (me + him?)

I assume you are beneficiary and your USC wife is the petitioner. Your wife needs to answer all the questions honestly and correctly that she needs to answer, you need to do the same and if there is a question which explicitly ask 'If you ever arrested?' then your answer should be 'YES' and provide explanation in a separate piece of paper and make sure to mention you were never convicted. If there aren't any questions about previous arrests then you don't need to volunteer information. I don't have the form in front of me but I think if I am not wrong it only ask for previous convictions. I honestly advise you to first go through the form that you (beneficiary) has to answer and if possible post those questions in this forum so we will be able to answer correctly.

Yes they actually ask if I have ever been arrested, to which I answered yes. I was just wondering what kind of explanation they were asking, right now I just wrote 2 lines saying I was arrested on XX for XX and was acquitted on XX and have never had other issues in the past. And my wife doesn't have tax returns because she graduated less than a year ago so I guess that's fine.

Also I'm currently out of status (my visa waver expired a month ago), should I join a letter explaining my situation? (which would basically just say i'm out of status).

hi

for the i864 she needs to fill out the form and write the letter, not you

and for the joint sponsor, he needs his taxes, at least 2014, and fill out the i864 of course as her joint sponsor

since he is single you don't need to send his W2s but his taxes yes

household size is 2 and he needs only a couple of last paystubs

and you don't need to mention that you are out of status, they know
