Pregnant and no insurance - About to do AoS

Hi! This is going to be a long one so please bear with me. Would appreciate any insight or advice we could get.

Here's a brief background. I am a K1 visa holder, and all of this happened this year, 2015:

April 19 - POE in Detroit, MI. I-94 good until July 17

June 16 - Got married in Georgia

June 23 - Applied for Social Security number which turned out to be a big fiasco. Long story short, I lacked documents (they told me about this later on), so no Social security number for me until after AOS

August - Got pregnant :)

My husband (who has a full time job as a grade school teacher) could not put me on his insurance and bank accounts because they all require a social security number. Because of this and that I am pregnant, we went to a low cost health center and they placed us on Emergency Medicaid to cover prenatal care. This expires January 2016 and after that, we may have to pay for delivery out of pocket (baby due April 2016).

We are currently working on AOS and will send out our package this week.

I have the following questions:

1.) Will getting emergency medicaid jeopardize our AOS application? Do we have to include in our cover letter that we have emergency medicaid?

2.) One question on the i-485 form is this: Have you ever received public assistance in the United States from any source, including the US Government (other than emergency medical treatment) or are you likely to received public assistance in the future? - Do I indicate Yes or No to this item?

This has been a bittersweet time for us. Happy and excited because we are having a baby, but worried about costs too. My USC husband has insurance...I just can't get on it because of Social security :(

Would be really thankful for any advice you can share with us. Thank you for taking the time to read this.

6/16/15 - Got married! ❤️

01/05/16 - Received I-797C for EAD, Travel Permit, and AOS via mail

01/29/16 - Biometrics

3/14/16 - AOS approved (no interview)

3/18/16 - Received Green card in the mail

4/03/16 - Baby T is here! ❤️

ROC:

1/25/18 - Sent ROC package via local post office

1/29/18 - Received I-797

5/05/18 - Received No Biometrics notice

8/11/18 - Received 18 mo extension letter

2/28/19 - ROC approved

You can get your SSN without AOS !

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

It will not impact the application

My husband is going to try and fight his insurance company to put me in. He is paying premium after all.

Many H1b workers' spouses who are on H4 do not have SSNs (since H4s generally cannot work, except the recent H4 EADs for some of them), yet obviously H1b workers who bring their H4 spouses can add them to the company plan with no problem. So SSNs are not required for health insurance.

Emergency medicaid is not considered for public charge. It should not impact your AOS(I-864), and I see no need to list that you have it on your cover letter.

I just don't understand why you can't get a SSN, it seems it would be easier to get your SSN as a K1 visa holder and not wait until you

have adjusted, then you could have been easily added to your husband's insurance.

You will require a SSN or a TIN to jointly file income taxes. The IRS will send you a nasty-gram if you file without either of those IDs. It is very important for Removal of Conditions that you file taxes jointly.

They could and should have gotten the SSN as soon as they entered with the K-1. They cannot get the SSN now based on the K-1 entry because they entered the US back in April. The I-94 is long expired. They will need at least the EAD in order to get it.
