we met,got engaged,started k1 visa together, got the visa ,booked the flight,then my US fiancee admitted that she been having an affair . now there is no way i can be with her again . i dont want to. my questions are :

1) is ther any way she can cancel my visa in the POE or before ?

* i do still want to go at least to visit some friends there and gain some experience..not to be with her or hurt her. i know i will have to return home after 90 days.

2) is there anyway i can sue her for this affair,since she signed the paper willing to marry me and sponsor me; i mean we can't be a game in their hands,.just because they are US citizen.i went through a lot and paid tpp much during this process and above all of that my love for her,so she wasted all this.. there should be any sort of rights for me as her victim of cheating and betrayal .

is there any thing i can do to maintain my rights as a victim of an american scammer ?

Yes she could have your visa canceled prior to PoE

No you do not really have a recourse to sue her, relationships international and domestic go sour all the time.

What you can do is move on. I know it can be difficult but it would be best. Try to get back to normalcy and enjoy life.

No you do not really have a recourse to sue her, relationships international and domestic go sour all the time.

What you can do is move on. I know it can be difficult but it would be best. Try to get back to normalcy and enjoy life.

1. Since you have no intention of marrying, it would be visa fraud for you to use the K-1 visa. She certainly can inform CBP that the relationship is over.

2. No. You can't sue based on a broken heart.

What rights are you referring to? You don't have any rights based on a broken heart. This is not what courts are for.

The K-1 visa is for you to come to the US to marry her.

You do not intend to marry her when you enter on the K-1.

She can get the visa cancelled based on the fact that you do not intend to marry her.

It's visa fraud for you to enter on the K-1 when you do not intend to marry.

OP you cannot enter on K1 with knowledge you no longer wants her, she

may have already informed immigration the relationship is over...I

don't subscribe to cheating, but did you not give it a thought to talked

it over, there's no excuse for cheating & its hurts but why do we ask for

forgiveness but refuse to forgive....have you cheated? I don't judge you

for wanting out but you don't mention love seem the concern is getting into

the US....If she was coming clean B4 you get here...you may have jump

the gun.

Sue for what? In that case the world would have sued someone at one point

or another....thinking on that line makes one seem a taker wanting to take

everything from another that they did not earn.

Move on get a tourist visa, you may get points from doing the right thing &

cancelling a visa you are no longer eligible for and get the tourist visa due to

honesty

You will be breaking the law if you enter the U.S. using that K-1 visa just to be a tourist for 3 months. That's fraud, pure and simple. K-1 is for people who intend to marry within 90 days, not so they can visit their friends for 90 days.

OP, truly sorry about your situation; however, at least you didn't uproot your life to come here and have to go home again. Others above are correct in saying that using the K-1 visa for "tourist" purposes is not permissible. Good luck to you.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
