Haven't recieved NOA, have tickets to leave the country in 2 weeks

Hi there VJ,

I'm wondering what our next steps are. We haven't received an NOA on my hubbys I751, because it got sent back for us to redo some parts, but his grandparents bought tickets for us to visit over xmas. We leave the 22nd. What do we do to ensure he is allowed back in the country from scotland?

But it looks like your green card is already expired, and that won't work for travelling. In that case you'll need to get a stamp in your passport, since you don't have a paper NOA extension letter. I think an InfoPass appointment is in order, based on other threads I've seen like this?

Wait, your timeline says you received his green card in July 2013 but you applied to remove conditions in October of 2015.

1. Was the green card already 3 months expired when you applied for ROC?

2. Did you include a letter explaining why you filed late?

3. When did you send the correct paperwork back?

Without the NOA or a stamp in his passport, there isn't anything you can do like Lynkali said.

Didn't happen to us when we first submitted the I-751, but when my wife's one year extension notice was about to expire as well as her foreign passport. Had to make a 600 mile round trip to Chicago to get her passport renewed, very slow, kept on in the waiting room in an empty place for seven hours. Than another 450 mile trip to the St. Paul office for that I-551 stamp in her new foreign passport with proof we submitted all the paper work.

We thought all this was done when she received her US citizenship and US passport, then we learned our DOS made an agreement with her home country, she still had to maintain her foreign passport, that also required her to renew her citizenship in that country. What a mess, and still is.

Reason for this is her place of birth is stamped right into her US Passport, called the DOS on this issue with conflicts with her oath to the USCIS, you are not dealing with the USCIS anymore, but us, and we need this for identification. What, with all the other paper work you have? It was always this way was told. Contacted my senator on this issue, has absolutely no say, neither does my congressman, strictly under the executive branch, and neither Bush or Obama would respond.

She just returned yesterday from seeing her mom, has to show both her foreign passport and US Passport to leave, she no longer can have a visa in her foreing passport.

If this wasn't the only problem at midnight Saturday night, her one flight was cancelled and no help from American Airlines, though luck. Was up the entire night using Flightstats to learn alternatives to get her back home, so she could request a different route, they don't do this. But had her flying all over the country and finally got her home last night.

See this I-751 process is still slow.

Ha, at the same time the head of the St. Paul office, actually in Bloomington, MN was very stubborn, wanted to get at least over a thousand people together before conducting it. Contacted my senator, he set up a special meeting for her, but we had to show up at 7:30 AM to get that peice of paper. She just received her ten year card a week before and had to give it back. Some others were also there from Wisconsin, they never got their ten year card, but that was okay. New office manager now, would give same day oaths, but only if you had an appointment in the morning. My step daughter received her appointment at 1:00 PM, so had to make another long trip in February with snow on the ground to get that piece of paper.

She also needs two passports, and you are not a US citizen like you were born here. Are if both your parents are illegal, what a screwed up country we live in.

Were you able to make an infopass appointment right away? We were desparate at the time, had to do this on the computer and every slot was full.

Learned from this board, I think it was at 5:00 AM, maybe 4:00 AM is when our office would refresh for any cancellations, and had to keep refreshing my computer and grab the very first opening, regardless of the time for that opening. Have to base your entire life around the USCIS.

Another option is if you don't need to travel, can bring in two passport photos and apply for an I-94 just to keep yourself legal. Our state passed a law, holding the employers responsible for checking the legal status, and if you are not documented, would fire you because they could be fined $16,300.00 if you were not. But of course, they will say, what in the hell is an I-94.
