Removing "Conditional Permanent Resident Status"

Hi All,

I'm confused about WHEN to submit our I-751 petition for lifting the "conditional permanent resident" status...

After being granted the CR1 for my wife (along with visa's for my two step kids), we were given a document instructing us on how to lift the conditional permanent resident status...

(It was "conditional" I believe because we were married for less than 2 years by the time we arrived in the states)

In the instructions, it specifically says, "You and your spouse must file an I-751, a joint petition to have the conditional basis of your status removed. The petition must be filed within a 90 days period immediately preceding the second anniversary of the date you were granted Conditional Permanent Resident Status."

Are you guys reading that the way I am? That we have to wait just under 2 years from the date we arrived in the states to file the I-751 (90 days prior to 2 years to be exact)... and that we can't apply for it before then?

You file the I-751 up to 90 days before the expiration on the 2 year green card. You cannot file it sooner and you should file before the card expires.

If you are filing jointly, the ROC petition filing window opens up 90 calendar days before the expirations of your 2-year conditional GC. If they receive your ROC petition prior to the 90 day filing window opens, they will reject your petition. If you file after the 2 year anniversary date on which you were granted conditional status (expiration date of 2-yr GC), you will automatically lose your permanent resident status.
