I-129F Consulate Change

Hi Guys,

My (now) wife and I got married in March, while we both lived in Taipei, Taiwan. We immediately filed our Applications in terms of I-130 and I-129. We also indicated that we would process my visa at the American Institute in Taiwan.

In the meanwhile, we left Taiwan, she went back to the States, and I went back to South Africa.

Both our applications were approved in the beginning of November and we received our NOA2 on or about 10 November 2015.

As previously mentioned, I moved back to South Africa.

How do we change the Consulate from which I will apply for my Visa, it being South Africa now, not Taiwan as listed.

My wife and I both filed queries with the NVC, to which we never received a reply. My wife phoned the NVC and they explained a simple process of emailing them when we receive a NVC case number, but I suspect that it is only applicable to the I-130 petition, not the I-129.

I am specifically asking about the I-129 petition, as the NOA2 states that my approved petition has been forwarded to the listed consulate, which would be Taiwan.

I would really appreciate to some advice on the matter as USCIS have been very vague as to how to approach this problem. Should we file a I-824 form, with the $400 fee? Or is there some alternative action that must be taken?

the k3 process is almost obsolete, so don't worry about it. it will be administratively closed and you will go through consular processing

Hi,

Apologies for my ignorance on the topic but, I have no idea what you are trying to tell me. As mentioned above, our petitions have been approved, I suspect my 129f visa information have already been sent to Taiwan although I am no longer resident there.

What do you mean by "consular processing"?

The K3 petition will be closed in favor of the CR1 petition. You will need to find out where the I-130 is in the process and attempt to make a change. The US citizen spouse should do this. They filed the petition.

If it makes its way to Taiwan then you will have to send/submit a tranfer request there. It will likely happen, and most definitely will add time to the process.

Thanks for your advice. Exactly how does my spouse make the change?

Both Petitions, in the USCIS website is stated as "Case was sent to the Department of State for Visa processing".

We contacted Taiwan, they just referred us to the NVC website.

We contacted the NVC, they never replied to our e-mail queries, and the single telephonic conversation we had, they offered no solution as to the I-129f.

It has been 37 days since our petitions were approved and currently it seems no progress have been made.

Both petitions go to the NVC first. No matter what the noa2 says, they need case numbers to be forwarded and processed correctly. If the I-129F reaches the NVC at the same time as the I-130 the NVC will close the I-129F and the K3 route. You will then continue on the IR1/CR1 path.

You need to contact the NVC to get your case numbers. That will tell you if the case is routed correctly to right city.
