Hello Guys,

I am new to the immigration forum so please forgive me if I am posting this question on the wrong thread.
I have done little bit of research on this but couldn;t find a clear answer.

My question is related to I-864 and I-864A.

So here is the situation. My mom does not have any income of her own and she is the petitioner for my sister.
She does have some assets and some money in the bank which can be included on the I-864 form. My mom lives with
my brother in the US who has his own family as well. He is doctor and has a very good income.

My first question is there a way that we could only show only sponsor which would be my brother in my case?
does the petitioner have to be a sponsor?

>If not then which forms does my mom has to fill out? I-864?
>For my brother does he needs to fill out I-864 or I-864A or both? This is a big confusion.
I am sure the visa officers would love to know how big is the family unit of my brother but if I fill
just fill out I-864A then it does not ask for that information.
> My bother has included my mother in his taxes? What does my mom have to write in her form under total income and total taxes?

I would appreciate if someone could answer my questions asap.

Thanks in advance!!!!

hi

no, the petitioner is ALWAYS the primary sponsor, she will file the I864 and attach a letter stating why she doesn't have to file taxes

your brother will file another i864 as your mom's joint sponsor

he doesn't file the i864A because there is no income to be combined with your mom, since she doesn't have income

your mom doesn't need to put any assets, since she will have a joint sponsor that will cover your sister

Hello Aleful,

Thanks for your reply........However, I don't understand one thing since my mother lives with my brother and she is the primary sponsor although she doesn't have any income .Is my brother suppose to fill out I-864A.
