Letters written by others is nice and all but bears little weight....any one can write a letter.

You not having child support and wanting another kid is not hardship in the eyes of immigration....

There are some more things that I think that gives more strengh... like: I suffered 2 assaults at my house already... My ex partner attack me physically and made threats to my life (we attached all the police reports of all of these stuff), kids loosing school time and loosing their english, kids call the stepfather as daddy because is their only reference and they are having psych problems, the finantial situation of the country, where I work as a doctor (an average of 90 hours shift/ weekly!!!) and I get monthly less than U$4000, I´m jewish and here in Brazil I can´t keep a good religious education for the kids, husband having health issues that can grow if I don´t come back soon, he has been bad evaluated by his job because of my absence there (he´s always sad and lost concentration)... and others that concerns my husband, me and the kids...

About wanting another kid, the biggest point is that if I get too much time, the USC will never be able to have his own kid, I´m getting old... and he´s younger than me.

What do you think?

Honestly?

Yes most of it is weak. Now the one thing that would make it strong is your husbands health. Did you submit any papers from his doctor stating his health will get worse without you here?

Did you ever heard that they sometimes open a RFE just to ask fingerprints?

But I wouldn't worry too much. It could be something really simple. Did you guys try to call and figure out what the ref is about?

I have a friend that got a RFE but it was when her fiancé sent the form I129F for the visa k1.... That RFE was because the attorney filled wrong the form so with the RFE they had to fix that form and send it again, now she has the visa and she will travel the next year.....just have a little more patience the RFE is something you have to include or correct ;)

Yeah... I´m waiting the letter and I´m so anxious... It seems that is taking forever!

Follow the letter to a T on whats requested for RFE.....I 212 can take weeks or up to a yr, depending on how fast

your jurisdiction adjudicates......hope you get that soon

No, I didn´t yet...

When it get a week completed I´ll call... I just receive the email these days, so I have to wait a little bit more the mail... I´m just anxious...

Follow the letter to a T on whats requested for RFE.....I 212 can take weeks or up to a yr, depending on how fast

your jurisdiction adjudicates......hope you get that soon

Yes, I know... As it makes just less than a week that I received the information by email, Ill wait a little bit more.

I think they were fast... In 1 month they received and they already saw something to ask for the RFE...

I preffer even be rejected fast, than take forever to be rejected or whatever...

It is in Long Island Office... Do you know if they are fast with these kind of cases?

Long Island covers a vast NY area so they may

adjudicate quickly, however remember the NY

tri-state area has thousands with paper-work in

too, and they will process by whose first & have

supplied everything to make the process smoother

Omg... And I received the letter... I couldn't believe what I read... Really...

"Your Form I-212 application is missing evidence of your visa refusal and inadmissibility as determined by a U.S. consulate. There is no record that you were interviewed outside the United States by a U.S. consular officer and found ineligible to an immigrant visa based on a ground of inadmissibility that can be waived."

So... They don't know what is a solo I-212... How can it be? Omg... It looks a nightmare...

I'm like a stupid trying to make it done before my interview... And that's what happens... :(

Oh girl so sorry :( i thought you had an interview before ask that waiver....i read that you have to ask your visa in this case k3 and then when you have the interview they will let you know what kind of waiver you need ? so sorry you got that answer

? Or my lawyer is wrong or the people from USCIS are wrong... I dont have a waiver! This is the point! I just need a "consentiment to reapply", not a waiver! And it doesn't need an interview to know that and to have that accepted!

USCIS sent that to Nebrasca (where they adjudicate the I-601 waivers), and that's why they are asking that... It was supposed to be at the POE where I sent (Long Island) and be accepted there!

My lawyer will contact the Senator Liaison...

I just don't understand how they don't know how to handle their own stuff...

Receive this thing to say destroyed me...

I imagine how sad you are and so sorry :( i understand because i have the same case but im trying to get k1 visa. Last Monday my fiance sent the form I-212 with all the supports to Nebraska because that is the office that handles the I-212. Before starting with all this process we talked with different attorneys and they said the correct way is get the interview and then the consul of the embassy will give you a letter with the instructions to ask the waiver I-212 or I-601, that's what we did i had the interview asking the k1 visa and the consul gave me the letter with the instructions to ask the waiver I-212. We sent the form I-212 and now we have to wait the future answer.... i have read a lot about cases with removal order and the correct way is have an interview in the embassy of your country asking a visa in your case K3 because you are married, in that moment they will decide if you apply for a waiver or not.

The letter of the RFE arrived as my birthday gift... :(

I understand what you say about send the I-212. But most of the people don't understand that it can be sent before the interview and if there's an I-601 to make after that, it can be done.

I just want to bridge the time and all of this that I'm saying exist at the law of USCIS, but there are just a few cases that people does that.

I swear to God... If I'll not be able to be with my husband in 2016, I don't know if I'll have health enough to wait more. For him, I can wait until I die, but I'm loosing my health already...

A lone 212 can be sent If needed, {its just a consent to DHS to enter if no other issues exist}

some jurisdiction not familiar with the process think it should go to Nebraska, that's one

reason there;s crazy timelines on solo 212, because it get sent back & forth at times
