Hi all!

I whould like to know if someone already have been through this:

I filed a solo I-212 (removal) and it was received by Long Island Office (my POE was JFK) on 10/22/2015.

My ban is 5 years and I got a 7(ii)(i)... "intent immigrant without an immigrat visa".

And than, I got married and now me and my husband we filled an I-30 at the same time we already filled the solo I-212.

This week I received (already!!!) a RFE for my I-212.

I´d like to know which are the most common RFE´s that they ask for.

And if after that, the answer is fast or not...

I´m so confused and scared...

When were you deported/removed from the USA?

Your I-212 is being returned most likely because you are still under a 5 year ban. Until your ban is lifted you cannot apply for readmission into the USA.

Second, and someone correct me if I am wrong but I-212 is only for those (with not immigrant intent) seeking readmission into the USA that would otherwise not need a visa to enter?

Well, I was removed from USA in march of 2014, JFK (NY).

I was planning with my boyfriend to fill a K1 visa and as I was for almost 1 year in America (I extended my tourist visa), they thought that I was trying to immigrate and removed me.

But, after that, me and my partner we got married abroad, and we filled an I-30 (he´s an USC) and we are waiting for that at the same time.

So, as an immigrant I need to request all the paperwork for my greencard, together with an I-212, to get in America back again.

I-212 can be for people who were removed and is getting an immigration status too.

I was about to wait the 5 year ban just if I was requesting a non immigrant visa, but as an immigrant I can do it whenever I want!

Do you know about I-212 RFE´s? :)

Hi.. i'm in the same process, i asked the visa k1 to get marry in USA but now i have to send the I212 waiver, we have almost all the documents but i don't know where we have to send them (what office ) and how to pay the fee..can anyone explain me please?

Tell me why do you have to send the I-212 (deported?, removed?, which airport?, when?) then I can tell you what I know about.

Hi!! I'm great thank you ;) I traveled the last year to USA with my turist visa but when I was in Atlanta airport the officer suspected I wanted to work so I was deported and they cancelled my visa for that reason I couldn't get the fiancée visa right now and I have to ask that waiver to can go again to USA and marry my boy ❤️ It was a terrible experience and now I just want to be with my love so we have all the documents ready but we don't know what's the address to send them and how to pay that fee...I appreciate your help ? thank you

Oh, ok!

So, you have to look for the jurisdiction office closer to Atlanta airport that you were removed!

Sometimes it has more than 1 but what I can tell you (I was from JFK and they have 3 offices!) is that try one by one!

And, I´ll be really honest with you... Talk with your partner and see if you both are maybe ready to wait a long time or even not be accepted...

I decided with my better part to marry in spite of getting the K1 visa, because than I was supposed to be an immigrant and it is much more important and relevant to them to accept a solo I-212...

Thank you for your answer...I'm gonna look the jurisdiction...we knew this process wasn't easy and we needed this waiver ( we talked with a lawyer) I'm sure the waiver will be positive for the proofs we have, my fiancé has a major disease and he needs me there so that's a extreme hardship and finally I didn't do nothing in USA. We don't want our wedding here in Colombia because that process takes more time and in that case I would need the waiver too :(

About the RFE.... what proofs did you send ? 'Maybe there is something you needed to send aditional...in my case when I had the interview for k1 visa the consul told me I only needed the I212 waiver and I researched what proofs I needed and my fiancé made a letter explaining the extreme hardship ( health, work,lenguage,security and Unemployment rate) and in every thing he attached proofs, we are waiting the doctor certificate and then we can send the documents to ucsis :D I know when they send the RFE is because they need something more maybe proofs or something aditional on the form you sent....I hope you can get the letter where they explain what you need to send or complete ;)

Oh, I uderstand...

In Brazil the marriage it was supposed to take longer because my husband don´t speak portuguese, so you know what we did?

We got married in Bahamas! Cheap to go, cheap to make a cute and nice celebration and the marriage certificate, you receive a proof at the time of the marriage and the real certificate in 3 days!!!

Yes, is always really good talk to a lawyer and study about the things.

And I know what you mean... I was there with no work, not illegal, keeping my job here in Brazil, but they still wanted to remove me... Unfortunatelly they get a lot of people who are pretty ok... And it seems that it is starting to be common... :(

But... let´s be strong and keep our journey right? ;)

Oh, I don´t know...

We made a nice thing with the I-212... I took 5 letters from people who know me (from teachers until closer friends, family and employers) explaining that I´m not a "criminal" and the hardship for me is finantial (I have 2 kids from another marriage with no child support - my ex dissapeared to don´t pay the stuff) and I want to have a kid with my husband, but I´m almost on my 40´s and I can´t wait too much... There´s a lot of stuff on that... And we filed with the lawyer...

My lawyer said that it can be just a request of fingerprints (that I can´t do because I´m in Brazil) and they sometimes do that just to be sure that my documents are real and I exist...

I´m so sad, nervous...

Ah, I hope we all will be able to resolve all our situations!

Wrong wrong OP got a RFE not a refused I 212.......OP you must send whats requested for your case to move forward in adjudication

I 212 is for every eligible to immigrate to thr US......D# (waiver) is for temporary visits & applicants must prove to CO there is no immigrant intent

Letters written by others is nice and all but bears little weight....any one can write a letter.

You not having child support and wanting another kid is not hardship in the eyes of immigration....
