Stupid question

I have a friend that got married last year to a Filipina. He was once married to a Filipina too. He went to court here is US and judge told him his divorce petition is approved, then he immediately flew to Philippines to marry the girl she met without the divorce decree. Now here is the problem, when he came back here in US, he got the divorce decree from the mail and found out that his divorce was finalized one week after he married her second Filipina wife.

Is there any suggestion to fix this issue or hiring lawyer is the only option here.

I know that the marriage was invalid but Im not sure if getting married again is an option.

I potentially see more issues then just getting married before the divorce was complete. E.g. how long was he married to his first Filipino wife before they got divorced? When did he meet his new Filipino "wife"? How long were they in a relationship before they got "married"? Had they meet in person before or the first time they met is when they got just got "married"? These are things US immigrations will look at. Not to mention that bigamy is illegal in the Philippines and can carry a prison sentence.

I think your friend definitely needs a lawyer. One that can help your friend in the Philippines with the mess of having married someone while still being married to someone else. And maybe a good immigration lawyer to help your friend here in the US, depending on the answers to those questions.

Yes he will need to get married legally now.

The quick divorce and re-marriage will be an issue, especially if he petitioned his first wife for a visa too.

He was married to his first Filipina wife for a year, then got separated. He met the girl on line and started chatting with her for 10 months and decided to visit her for two weeks. As soon as he came back here he started to file for divorce and attended the court hearing then the judge told him he approved the divorce. Two weeks after the hearing he decided to go back to Philippines to marry her girl knowing the fact that his divorced was finalized on the the same day of hearing. They got married without showing the divorce decree (I dont know how but it happened). He stayed there for two months, of course they have their honeymoon. But when he got back home, he just received the letter saying the date of his divorce decree which is one week before his marriage. They are planning to hire a lawyer but still exploring the idea if they can do it on their own.

Yes you are right, his 1st wife came here thru spousal visa and the same route he will do to his 2nd wife.

Your friend is an accidental bigamist. Time for a lawyer. Not a DIY at this point.
