Just a few specific questions regarding TN-status

Hello! New to the forum and I really would appreciate some help.

I've been freelancing for an employer now for about 5 years from Canada (they're located in California). They recently made the decision that they want to bring me in-house on TN-status in February.

Now, this past year I've been travelling to the US quite a bit, mainly California for conventions like Comic Con, and to visit a few of my former schoolmates live there. I traveled enough that on my most recent trip back in August I was sent for extra questioning in secondary inspection, but was let through fortunately (I am now red flagged, I've come to understand).

My first question is, would this red-flagging affect my chances at obtaining TN-status?

As well, is having the company on my resume that's sponsoring me grounds for denial?

I want to make sure as well as I can that this is obtainable, and definitely do not want to get denied at the border. Should I opt for an H1-B instead if the company's willing? Or perhaps wait a little bit longer in Canada before applying?

Both of the things you listed will certainly affect your chances at getting the TN. You have to be able to show them that the employment is temporary and that you don't have immigrant intent. They could have an issue with either of those things as you have an ongoing history with this company and a only 3 months since you were questioned at entry.

Nothing you have listed is outright grounds for denial, but they will conceivably make it more difficult to obtain the TN.

Thanks so much for the reply Dakine10! Definitely need to look at maybe obtaining a different visa then. I'm afraid of the risk of being turned away, so maybe in this case it'd be better to be safe than sorry.
