Canadian visiting Houston

Hi everyone, I am a Canadian living in Toronto , I have been visiting my boyfriend who is a US citizen and living in Houston Texas several time for the past 3 years, but I never stayed more than 2 weeks. I never used visa or anything, i just say i am visiting my boyfriend.

I am planning to visit the US and try living with him longer and maybe quit my job, if we decide to get married in the U.S. , would it be okay? I heard conflicting news. I am confused. Thank you.

It's perfectly fine to marry but you must go back to Canada and wait out the process. Well except for visits. To plan in advance to get married and then adjust is basically fraud. But the getting married part is just fine, many of us have done it.

if you get married and stay in the US and file AOS you also cannot work or leave the uS while waiting for that be completed and AOS can take up to a year to be completed from what i understand. A CR-1 visa takes about 8 months - my advice, suck it up, keep your job and continue to visit while you wait for the cr-1 process to complete that way when its done you can move, hassle free, come back n forth hassle free and be able to work.

I dont know if i plan on getting married. Marriage is one of the outcomes of living together. I am not exactly lying, would this explaniation work when adjusting my status? But thanks for your advices.

Nicole_1228: thanks for your response, is CR 1 the finacee visa? I heard the success rate isnt that high in Toronto, are those visa hard to get?? Thanks again

No not really, you already thinking about it kinda makes it look planned. Especially if you quit your job an move here! A spur of the moment wedding is one thing but this all sounds like you have no intent of going back.

Cr1 visa is the spouse visa. K1 is fiancé. I doubt that Canada is a very difficult country to get a fiancé visa

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

There's no "not exactly lying." There's lying and then there's not lying. Do you plan on getting married, staying in the USA, and adjusting your status? Is that the intent of going to the USA? If the answer to this is yes, you'll be denied entry. Anything other than that is visa fraud and is lying. To suggest you do so is against the TOS for VJ. If you don't know what your plans are but are pretty sure that's what they will be, the answer is still likely still yes. Quitting your job breaks one of your most important ties to Canada.

You have thus far not LIVED in the USA. You have visited. If you want to move to the USA, the best idea would be to do a K1 visa at this time. You can continue to visit but you can make those plans to go down, get married, and stay, after the visa is granted. With US immigration you cannot do the whole "lets live together a little while and see how it works" like you would with someone from Canada. It just doesn't work that way. You have to have the intent to get married or to be married if you want to live down here.

There are no fiance or spousal visas out of Toronto... All visa interviews for spouses (CR1/IR1 and F2A) are done in Montreal and all fiance (K1) interviews are done in either Montreal or Vancouver. But Canada is a low fraud country and pretty easy to get through. The issue becomes more if you were originally born in a country that is high fraud or have a lot of family in one.

The K1 path starts with an I-129F

The CR1 path starts after marriage with an I-130

Couldn't agree with NLR more. You are cutting ties to Canada and already talk about 'living' in the United States. To suggest you go and adjust status is against the TOS here because it is visa fraud.

Since you already qualify for the K-1 fiance visa, file now and go and visit.
