Yes, if you two were married for over two years when you get your GC approved, you should go straight to GC holder and skip the conditional part. No ROC for you!

I think this question is more appropriate on this forum:

http://www.visajourney.com/forums/forum/152-military-immigration-related-discussion/

If your husband is a contractor, there may be different rules applying, but there may be similar forms. The good thing is that you could be eligible to get your citizenship faster than all of us. Once you get your GC, you may be able to apply for citizenship without needing to wait for the marriage and GC holder time! Check out that forum, and see if anything from this thread applies to your situation:

Awesome thank you. This process is quite stressful and nerve wrecking

Well, well, well, is that you, Jess??

You will get an NOA to prove that you AOS'd, but the requirement is that you MARRY within 90 days, not AOS within 90 days. You don't necessarily need to carry the NOA, as it's only proof that you applied for permanent residency.

I think a week is a reasonable time to be able to assemble everything for AOS. Make sure you print the latest affidavit of support form. I think we spent more time on the support documents than anything else because I included an analysis of health insurance and proof that he's under my policy now. In reality, you really aren't required to provide proof of relationship during AOS, but you do for ROC.

Yep, it's us again! Still in Mexico at the moment, just so f'ing happy to have been approved. Thanks for your response-we will plan on 2 weeks to do all the papers and then hope it's finished sooner. I'm not sure he will have any insurance except what we will pay for-sadly.

But I'm hearing two things on this forum. One, like you said, that we need to MARRY within 90 days. However, I think in one of the Wikis it said we must have everything FILED within 90 days because his I-94 will expire and even though he is married at that point that alone doesn't confer legal status.

I will try to find this and post a link to it.

This has us pretty stressed because it's still bad weather where we live and (for a few other reasons) it would be hard to pull off even a fairly simple civil ceremony with just a few friends in time to have all papers filed. Of course if we only need to be married within 90 days that would be way more simple.

So at this point we don't know whether to go home or wait here.

Any advice would be appreciated. I will look for that wiki I read.

It's best to file the AOS as fast as possible because it shortens the wait your husband will have waiting for his EAD/AP and/or GC. After the I-94 expires, you kind of hit a limbo where most stuff is expired and you are waiting on that card to renew stuff, like driver's license. The SSA wouldn't give my guy an SSN since we applied after we married (although other people have been able to get their SSN after marriage.) That was a different limbo for us, but most people get their SSN before AOS and have no problems with that. When you see his I-94, you should be able to apply for the SSN - you don't need to wait the two-three weeks the VJ guide suggests anymore.

Once you two marry, he's eligible for GC, and therefore is administratively safe from deportation. DHS isn't going to spend the time and money to deport someone when they can easily file AOS at any second to remain. If you wait after the 90 days to file, but you two still marry within that 90 days, he's good, but will begin to incur overstay. However, once you file the AOS, the overstay is forgiven, so it's no harm, no foul.

My husband and I filed within 30 days after his arrival, mostly because we were waiting on the marriage certificate to come back from the County as recorded/filed. When we went to the County Courthouse to get a copy, it hadn't been processed, so we were able to take the original and certified copies home with us. Between that time, we were getting the papers together and saving up the chunk of dough for the filing fee.

However, at the beginning of February, we still hit that limbo time. Our limbo time could have been reduced to two weeks, but the state messed us up with that...long story...

Try filing the AOS sooner, but it's not a requirement - just marry within 90 days of entering the US and he's good!

I filed our AOS 2 months after the I-94 expiration and was no problem. You have 180 days of overstay before there's an issue and the clock stops with a pending application.

The last three weeks have been quite busy for me. Started a new job with the EAD, got a car and a new apartment.

And suddenly, out of the blue last week I received a text from USCIS that my GC is approved! Yesterday it was delivered.

Such a relief to finally be settled and not worry about USCIS forms (at least for the next year and a half until the I-751).

Does anybody know if my company needs me to sign another I-9? I signed it with the EAD and I don't know if anything changes now that I have the GC.
