December 2015 AOS filer status

Lol, yep.

Now where can I find me some?!

Even though USCIS is still within the timeframe atm, it's just the anxiety of not knowing if there will be a surprise RFE/RFIE so close to the finish line (for EAD) and knowing that sometimes they go over 100 days...in short the unknown is what makes this stressful?.

^ This. I decided to call the NCSC instead of filing out the online form. Got the most happy, charming and knowledgeable lady. Knew all about the 'ART SR', just did what I asked - well done, USCIS. The cynic in me says "she must be new". :P

She also hinted that getting my hands on an interim 240 day EAD if the case goes beyond 90 days is hit and miss. Some offices will issue them, some won't. It kinda sound like "good luck if it comes to that".

I called as well, I needed the 'comfort' of talking to someone to feel secure that it would be pushed along...I'm sure the online system is fine, but I didn't want to chance it. I was impressed how quickly I got through to a person, only took a few mins and she was fine and understood my request which was a a relief!

I haven't seen anything that says sending proof that the relationship is bonafide is a requirement for AOS! When your significant other moves in with you, you don't use the Internet messaging services nearly as much. Being a K-1 visa entrant, you only get a conditional GC anyway, so that's strange. The application is based on marriage, not really relationship. I always thought that bonafide relationship mattered at ROC!

Hopefully you can overnight them the things. I was reading a different post of someone waiting for their case status to change to acknowledge USCIS received the documents (which you seem to already have a problem with your case status) that they backdate the message. How unbelievable aggravating!

I think it's pretty accurate. Call the USCIS tomorrow, which is your 75 day mark, and put in your service request, if you wish.

We got our RFIE letter today. They need a tax return document, which we already have included! :o

Oh well, I will send it out tomorrow!!

Can someone clarify this for us?

The RFIE we received says "the petitioner/sponsor on Form I-864 must submit a complete Federal income tax return submitted to the IRS for the most recent tax year".

Our confusion is that it is time for tax returns of year 2015. Are we okay for sending a copies of year 2014 tax returns (W2 and Form 1040)? or do we file year 2015 returns and send that to USCIS?

If you have filed for 2015, then I would include those copies. Otherwise, include 2014 and perhaps a note that you have yet to file your 2015 tax return. The USCIS can't decide to force you to file before the due date of the return.

Did you send transcripts or copies? (I know we aren't going to file until we can get my husband's SSN, so the IRS needs to wait on USCIS! Lol!)

Unless you want to risk another RFE or denial, I'd suggest you file your taxes first and send the most recent tax year. to the IRS for the most recent tax year to me means 2015 tax year.

Interestingly, the RFIE letter has the word "complete" underlined in red! We are assuming that they misplaced a part of the pages we sent!! Lol!

We are trying to interpret the same. Our logic is that we filed the paperwork by end of December, so at that point we had the 2014 paperwork as the latest.

Today we hit day 76, so I decided to call USCIS to see what's the EAD/AP status and if they can send it to me already cause I'm getting crazy over here (or maybe I said expedite? never mind...)

When they asked me what was my reason to expedite it I told the truth - we are on day 76 and I was approached by recruiters on linkedin regarding job opportunities.

At first I thought nothing is going to happen because the woman on the phone was very robotic in her answers and questions and sounded like she's reading off of a page.

To my surprise, about two and a half hours later I got 2 texts, one for each case - EAD/AP approved and the EAD card is being produced!

We had our biometrics on the 28th of January (appointment, not early walk in). Besides a name correction, it's been very quiet. This part is very weird for us because we're always commenting, "Should we be filling out some paperwork right now for the next step?"

They are supposed to accept copies or transcripts, but I sent transcripts for all the years so they know what the IRS has on file. Did you include all the schedules with the return as well? Did you have any Form 1099 for any other source of income that you did not submit?

You are also entitled to get an extension of filing your tax return, so the USCIS needs to accommodate that, if need be. I know I sent in three month's worth of paystubs for the last part of 2015 so they could see what my current income is. However, it doesn't seem like they are asking for that.

Were there any tax credits you took on your 2014 return that required an additional form that wasn't included?
