The VJ timeline estimate for EAD finally switched to December 1st. (Matches pretty close to what wiiil just posted!) I believe my husband and I will place a call with USCIS on Monday and hope that February 22nd is in fact our 75th day. So far, it seems the reps go on uscis.gov, ask you for your case number, type it in the "check your case status" option, and tell you what's going on. LOL!! If that's the case, then they should accept December 10th as the date. We will see?

Monday is also our Day 75 (based on the Notice Received date anyway). I'll be making a call too, assuming of course that nothing changes by then.

I always thought we counted from the NOA date, but I'd be glad to be wrong! I'm on day 50 from my NOA date...

I always thought we counted from the NOA date, but I'd be glad to be wrong! I'm on day 50 from my NOA date...

Hehe, Amhara and I had this debate the other day. :lol:

Things like this from Southern Illinois University Edwardsville suggest that it's the Received Date. Other more random sources suggest it's the Notice Date. Honestly, I'm not sure but as there's only 2 days between my Received and Notices dates it won't make a huge difference personally.

In other terrifying news, USCIS is proposing to scrap the 90 day regulated processing time for EADs. Here's the quote from the Federal Register:

"..in light of national security and fraud concerns, DHS is proposing to remove regulations that provide a 90- day processing timeline for EAD applications and that require the issuance of interim EADs if processing extends beyond the 90-day mark."

Wow! I understand why they would do this! Only the whole population of immigrants needs to suffer? I hope we can get ours in before this is implemented!

At the time of writing, this is only a proposed rule. The public consultation period is still open for another 11 days. I doubt that this will have an impact on those in this group but the impact on future filers could be pretty big.

I started another thread for this topic since it could impact a lot of people.

Mine is only a week so either way it's not a huge deal, even if it feels like one!

Oh boy, this is nice. Part of me doesn't understand at all why they don't want us contributing in taxes sooner rather than just increasing the population... But I guess it does deter people from just getting married to work here. It just sucks for those of us who are genuine!

There is one bonus for people who get stuck in GC limbo:

DHS proposes to automatically extend the validity of expiring EADs for up to 180 days from such document's and such employment authorization's expiration date in certain circumstances upon the timely filing of an application to renew such documents. Such automatic renewal would be available to individuals with pending applications for adjustment of status and other employment-authorized individuals

This means something different. Actually, this is a positive thing. What it's saying is that if someone has a pending AOS and have been approved, but their EAD is about to expire, they will get an automatic 180 days on their EAD. There are many different groups that qualify for this according to your source.

All of us here would fall under the "Aliens who have filed applications for adjustment of status under section 245 of the INA, 8 U.S.C. 1255. See 8 CFR 274a.12©(9)."

This also says, "Based on the above parameters, DHS has identified 15 employment authorization categories (where family based AOS is one) where renewal applicants would be able to receive automatic extensions under this proposed rule. Among these are applicants for adjustment of status. So long as their applications for adjustment of status remain pending or USCIS determines, upon written notice to the applicant or notice published in the Federal Register, that it must terminate the auto-extension by category, these applicants are eligible for employment authorization under current regulation. See 8 CFR 274a.12©(9). Because such eligibility is not contingent on the adjudication of a separate application, petition, or request, DHS believes it is reasonable to make automatic extensions available to such individuals."

So these individuals have already received their EAD's.

But, now I want to see this other part more closely. The "Elimination of 90-Day Processing Timeframe and Interim EADs"...

You know what I am thinking, reading your guys discussion on how the change in the EAD processing may affect us? It feels like they are trying to make adjust just a lot less straight forward / fast. If it should take up to a year until you can work/drive/anything after getting here on a K-1 or adjusting from any other visa, fewer people will want to do it and more will go with the Spouse Visa instead. Dont you think? At with that, a lot more processing happen when the potential immigrant is still outside of the country, giving them more time to potentially unearth info on any given person.

After what happened in San Bernardino I honestly would not be surprised, if they decided to make the K-1 harder to choose/ get.

We haven't gotten the letter for RFIE yet...7 days and more going. :clock: Wondering when it will show up.

We are now in the same boat. We got an RFIE for our EAD/AP!!!! No!!!!! We could have been approved today!!!! Dang!!!!!!!

Now we will need to wait for that stupid forever letter. Our GC status hasn't change (yet) so maybe it's something simple with the EAD/AP. We didn't sent biographical forms for just those two initially, so we mailed the forms a few days after we got the NOA's. Hopefully it's not for that because they should already have that. Gosh, maybe something with the name? I don't know...we will just have to wait and see...
