December 2015 AOS filer status

Hello everyone, google led me to this informative forum.

A little bit of background. I have been in US since 2006 on F1 and then H1. I got married in March of 2014. My wife is a green card holder. We filed for I-130 in 2014 and got it approved. Dates were not current ar that time.

I am in Boston, MA. December 2015 sent documents for AOS, USCIS recieved them on Dec 7. Noa's recieved after 2 business days.

Biometrics done Jan 6, Jan 8 recieved RFE for new version of I-864. Rfe response recieved by USCIS Jan 23.

Current status: As of Feb 3, 2016, we are ready to schedule your interview.

Questions:

1. How backlogged is the Boston office? I am not worried about EAD as I have a valid H1. How long would Boston office take to schedule interview.

2. Anyone else in Boston with similar timeline?

3. I would be married for over 2 years this March. The interview will be definitely after March. Would I still be getting conditional green card?

Hi andy9919, welcome to VJ!

1. According to USCIS, the Boston office is currently processing AOS cases from April 2015. There is no way to reliably know how long it might take for them to actually schedule your interview: some wait a month, others a year, some even longer than that. Based on their backlog, you might reasonably expect to wait 8-9 months.

2. There sure are. You can find people using your local office using the timeline search tool.

3. From my understanding, if you've been married for more than 2 years when your I-485 is approved, you'll get a 10 year green card.

Everyone in this group is still within the regulated processing time for EAD/AP. As for GC, one can only hope and wait.

Day 60 came and went. Still radio silence. 15 days until I can whack USCIS over the head with a Service Request.

Spent a while today reading about UK/US State Pension/Social Security reciprocity. Seems that qualifying years accrued in the UK automatically count towards Social Security here without any special filing required now. I knew about the reciprocity (under the 'Totalization Agreement') but not the ease of transferrability for qualifying years. Handy.

Plus side is it has been beautiful weather here in the Bay Area: spent the weekend cheering on Team Pony in the Super Bowl and pottering around the farm. With the warm/cold/warm weather cycle, our horses have shed enough hair to make cushions out of (should one have felt the urge). ^)^

Spent a while today reading about UK/US State Pension/Social Security reciprocity. Seems that qualifying years accrued in the UK automatically count towards Social Security here without any special filing required now. I knew about the reciprocity (under the 'Totalization Agreement') but not the ease of transferrability for qualifying years. Handy.

That's really handy information to know. Having paid UK NIC since 1985, I all but thought that would all be thrown away now that I have left the UK for the USA. If it could be transferred, that would be fantastic.

Yeah, it's one of those things that most British citizens are unaware of and is not published widely to ex-pats. Eligibility is subject to full year contributions and all other criteria, same as for qualifying NICs years in the UK. Studying the treaty is useful - albeit boring - and it came into effect in 1985, which might suit you down to the ground. ^^

We received a second Selective Service card in the mail last night. So now, we need to place another call to a federal agency and try to straighten the records out. One card is in the "FNU" name and the second name is in the name I put for the AOS. I'm really trying to figure out how the SSS got his name "FNU" on the first card as we sent the registration card before the AOS (not realizing the USCIS would register him separately) and we used the AOS name there too. So I would have thought the SSS would have used the AOS name on both cards, but hey, this is why I want his name change done soon. Just a pain in the tush!

For us, it's 20 more days until we hit the 80 day mark. I think the week of February 29th will be our status changing time...maybe?

I SEE WE HAVE A CHANGED DATE!!! YEA!!!!

This is what it said for our I-765 EAD Application

WHAT!!! DENIED!! WHY????

Then I notice a second one of our filings, the I-485application for our Green Card was also touched.

Here is what it said:

IS IT POSSIBLE WE GOT HIT BY LIGHTNING? A GREEN CARD IS ON THE WAY ????? NO INTERVIEW, NO NOTICE, APPROVAL IN 57 DAYS??

Our third filing for AP has not been touched.

Holding our breath running to the mailbox each day.......

Your fast approval would make sense given your wife's history of visas and such. But you guys are in there! Yes! Congrats again! You are the first December GC holder! Hopefully the card will be produced so soon!!!
