I'd like to share some good news in our process, although it's not too related with our immigration process. My husband's name change has FINALLY been approved by the district county court! We will go tomorrow to change it and that will be just in time before his bus pass is issued, so he should be able to get that in his new name too! We also have another driving road test tomorrow to see if we can lift his driving conditions (although his DL expires in another four days or so...) and his biometrics the end of this week.

I have been sick with some bug all this week and am coughing so badly. It would have been totally awesome to have been able to get these things done last week before getting this sick, but at least I have a sweetheart next to me taking care of me during this time. It's so much better to be sick with someone next to you! Hopefully my guy doesn't get it too, but so far he has been good.

Next week, we should be able to change his name through an InfoPass on Feb 11th, so we can get these immigration documents in the new name. As long as they don't issue his GC within a week after his biometrics, we should be good! Lol! Yay!

I think we will be fortunate enough to get EAD/AP issued within 90 days. It doesn't make sense to me on how they decide to work these cases. Coming into this process, I was thinking it was based on local office, but I have seen one lady in the October thread get approved for her GC within two months! She was also living in Dallas, so her whole case was worked in NBC. I would like to think that the "Ready for Interview" message is a positive sign, but I have seen people say they have been waiting 10+ months in that step with no sign of getting interviewed.

I just hope we get ours before a year is over. I don't think we need to redo a medical exam if the AOS was sent within a year of the K-1 medical - or I hope not anyways...

Actually at this point, I believe not getting an interview is a better sign for Dallas folks. I checked most of the local office processing times from uscis. Not a single office was still in 2014 except Dallas.

Actually at this point, I believe not getting an interview is a better sign for Dallas folks. I checked most of the local office processing times from uscis. Not a single office was still in 2014 except Dallas.

Yes, I think you are right. I had checked the dates before my husband arrived in the US and I was surprised at how backed up Dallas is!

I also noticed that the biometric office is different from the office where the InfoPass will be, so the reason they are backed up so much isn't that they have too many biometrics! All the timeframes available for the InfoPass were at really, really early times in the morning - as early as 6:40 am! I don't know what time I'd need to wake up to get to Irving by that time! It's hard enough for me to wake up by 6 am!

Another person in Dallas who filed late November, with NOA date of December 1st received a notice that their GC was being produced! This was right after they had a notification that their EAD/AP was being printed! So if Dallas people are getting to bypass interviews more, where procedurally appropriate, then perhaps it will be alright? We'll just have to see. The good thing is that February is a short month. We might start to see some movement with us December filers soon!

Any idea on your AP/EAD status? Or would they become moot with your GC looking like a mid March issue?

Ap/EAD status is still showing Case was received. But I am hoping to receive my combo card in February so I could pass my driving test asap

Tried to make an infopass appt the past couple days, and it keeps saying that they're currently not accepting appt for information.

Thus I tried to call USCIS, they said they can't help me because since my rfe wasn't posted and instead mailed to me, the only way I can seek help on it is by getting a lawyer, as they are legally not allowed to discuss that information with me. -_-

Exactly what I didn't want to do.

So I'm just going to wing it, try to see if they'll accept my husbands new job and deem him eligible to sponsor me, otherwise they'll send me another rfe right?

They're not going to decline my case right? They'll just send another rfe?

I don't understand though... my current sponsor was accepted when I applied for my visa, why isn't she accepted now?

Reading those RFE letters you posted, it looks like they want proof that your sponsor and joint sponsor meet the income guidelines. USCIS spelled out the evidence that you could send (pay stubs and/or a letter from the employer stating the particulars of employment) along with tax returns for the sponsor and joint sponsor. If you don't have all that they want, I'd love bomb them with everything that you can and write a cover letter explaining your situation. If they don't find that sufficient, they will write to you and ask for more evidence - this might delay your case (which sucks) but as long as you respond in the timeframe and manner they request? No, they should not deny the case nor consider it abandoned.

Yeah they said they're legally not allowed to discuss the rfe or anything relating to the rfe with me.. it was so weird. When I called she was super friendly and then I asked for help with me rfe and she was all like "okay!" And then idk what she read on the laptop, but then she turned into a serious robot and tried to get me off the phone quickly and ended with a "good luck on your case" and it freaked me out .-.

We just got a letter today from immigration, we didn't send of the I693 form because he had his medical within the last twelve months, what we foolishly didn't see however is that we needed to have sent his DS3025 form! We didn't, but we still have it, their instructions on the letter state to bring the 693 to interview or when they request it as evidence, but we're wondering if sending the DS form would be sufficient? If we had sent it at the time of the initial AOS it would have been I can see, but we just want to make sure it'll be fine to get sent off or brought to interview as opposed to seeing a dr here when he already has the evidence of being up to date and complete?

We didn't send anything regarding the medical exam. The guides were saying we didn't need to send the DS-3025 if we had the medical done as USCIS 'should' have records when you enter. First, the USEM kept his DS-3025 and returned it when he picked up his visa. Then, the entry agents at his POE kept that copy when he got here, so we have no record of the medical whatsoever! We have an appointment for the doctor's early next month for him to get him a physical and we intend to get his vaccines there just in case, but we may face a similar problem as you...only we don't have a copy. I think you guys should be good just taking the copy to your interview.

I think it's an offer letter for when they were offered the job. I sent mine which has my start date, starting pay and job title. If your co-sponsor doesn't have this now, or if it's too old to be relevant, could she get a letter from her boss confirming how long she has been there, her current salary and current position?

It's more of a confirmation of salary. Have his employer print it on the company letterhead or at least with the company logo at the top and say something along the lines of:

To Whom It May Concern;

This letter is to confirm that Mr X is currently employed at Company in (city, state). (insert something about the company, e.g. how many employees, how long ago established, annual revenue).

Mr X has been employed at Company since (start date) and holds the position of ______ on a full-time basis. Mr X is compensated a minimum of $XXXX per month, or $XXXXX annually.

Mr. X's employment is secure and ongoing. If you have any further questions or need more information, you are welcome to contact me.

I can't remember what else the RFE asked you to include, but you get the idea.

Our day didn't go so well. I woke up at 3:30 in the morning coughing terribly and I ran out of tissues. We had to stop three places before we found a place open 24 hours. (there seemed to be more places open 24 hours just a few years ago than there are now...) We were late to the court hearing, but thankfully we show up before proceedings began, so we got to squeeze in. However, come to find out, the FBI criminal history check was done with my last name as my husband's first name. So somehow, the mistake I did of putting my last name as my husband's last name on our AOS is causing further confusion! His name was not changed and hopefully we can get a new FBI check done on him soon. We just need his name change done and then we can worry about the AKA stuff later on!

Btw, the FBI check was done and misspelled my last name. I gotta tell you, that was icing on the cake. I'm in court looking like a pauper, feeling like poo, taking leave off work, not getting our mission accomplished, and they are going to misspell my last name? Where did they even get that from? If they got it from the AOS, could they have at least spelled it correctly? Could they have put his 'first' name as his 'first' name? Why isn't my cough going away? Why does Afghanistan have to be so archaic? :girlwerewolf2xn:

But in lighter news, we are one day away from biometrics and one more day without an RFE...so far...
