The took about two weeks to change our status from received RFE (initial) to ready for interview. It should go just as quickly for you - hopefully quicker!

Something that made me feel like I am one step further overall is that I passed my driving test today! Yay! Always going everywhere together was driving my husband insane. Now we are planning on getting a second car and he won't have to babysit me while driving anymore :-D And I can go to school on my own too.

The examiner was very nice and chatty, the entire thing took 10 mins, then he pronounced me a good driver, gave me the temporary stamp on the permit and wished me well. Very short and painless, I am so glad :-)

That's great news, congrats! Here in CA I have to wait until the EAD comes through before I can get a license, which is lame.

I hope you get your EAD soon then, it is not fun having no licence that's valid.

MA is nice like that - their drivers manual even states that they do not care about your immigration status, if you are eligible to get one (which I was because I entered on a K-1) that is enough to get your licence. Something to the effect of "It is not the job of the case worker at the RMV to determine your legal status in this country. This is between you and USCIS/DHS."

My I-94 only runs another 2 weeks, so yeah, I am glad it got done now.

Thanks, me too! I won't rant again about that particular frustration (much). If I were an undocumented alien, I could have a license, but because I'm playing by the rules, I cannot. Bit nuts really.

Babushka: Congrats. Hoping for the same speed

R&C: If you married on or before Dec 31 then your status for 2015 is married. I used Turbo Tax and when I entered and filed as married I saved a bunch of money in lower taxes because the married filing jointly bracket taxes are lower. Buy a version of Turbo Tax and the program does all the work for you and chooses the best class to file under.

To file as married your spouse will need a Social Security number. We filed for my wife's a few days after my wife arrived in the US. If you waited you may have difficulty getting it and that may impact when you file your taxes. Good Luck.

Hi there, my husband will also file as MFJ, did you include a statement about your non resident spouse to be treated as resident?

Just read what happened to this poor lady. I'm thinking that perhaps it's not a good idea to carry around the EAD/AP (combo) card? You should never need to unless proving your right to work to an employer and for international travel - unless there's something else it does that I'm unaware of?

We got our RFE yesterday and mailed it back to them today!

They stated that they needed my (petitioner) W-2 and other tax information (so I included my most recent 1040, etc.). I also included extra evidence such as the last 12 months of bank statements (they already have my pay stubs and letter from employer from the original package we submitted).

They also stated that I didn't meet the 125% income plus five times the amount...which I didn't know about! So I added a joint sponsor, just in case...with a new affidavit of support for them and the supporting documents (last year's W-2, 1040, and proof of American citizenship).

I hope that this suffices what they need! I basically sent my entire financial life to them! ...I'm so stressed out now :blink:

I'm in a similar situation and all we sent were two pay stubs (because that's all we had at the time), a letter from his employer stating date started, salary (annually and monthly), nature of his job and the type of revenue his employer makes (although looking at your RFE I'm now worried it wasn't detailed enough). We also included a letter explaining why he didn't have a tax return from last year (student in the UK = no taxable income). I think the explanation letter is key. We haven't had an RFE yet (although only on day 33).

Theoretically you SHOULD be fine without the joint sponsor since your spouse makes above 125% of the poverty line (which is around $16k annually if memory serves). If you get a good letter from his employer and write an accompanying letter of explanation for why he hadn't filed tax returns previously then you should be fine. Having said that, this is the one thing I am worried about getting an RFE for!
