December 2015 AOS filer status

Hello,

I am a US Citizen and we just got the NOA2 Approved and I am aware it now takes a bit of time to make it to the NVC then to the Embassy in Afghanistan where my fiance is. I wanted to ask a few things, one, we did get 'engaged' and did the nikkah, we do have pictures of this event, would it be wise NOT to include these as it may arise suspicion when my fiance has her interview? Anyone else have engagement photos and not have a problem? Again, this is for the fiance visa, the k3 or 129 form. Lastly, if everything goes smoothly, how long of a gap between my case being recieved by the embassy from the NVC, until my fiances' interview where inshALLAH she recieves her visa then and there.

This is the initial evidence they requested from me. However, I sent my "official vital records" (US Embassy in Turkey considers that official paper as a birth certificate) and its english translation together.

I am confused if they are asking "more" evidence or they simply say the official paper and its translation is not what they want ?

attached you can see the letter and the translation of my birth certificate. Anyone can give me any idea?

Did you include the Turkish original too? We included the Dari and English translated copies; the original and a certified translated version.

Hey Pekan sorry about your rfe. Vital statistics usually means you submitted a document that does not properly reflect your family background. Your mother and father's name have to show on any vital statistics document ex birth certificate, birth registry records and such..

Check to see if your current document has this information.

Hey Pekan sorry about your rfe. Vital statistics usually means you submitted a document that does not properly reflect your family background. Your mother and father's name have to show on any vital statistics document ex birth certificate, birth registry records and such..

Check to see if your current document has this information.

It is shown on the document. The vital record shows everything.

Each row is a member of my family. I am recorded on the first row.

Each column is the information that is needed such as date of birth , place of birth, mother name, father name etc..

I don't understand how this document is not sufficient.

I don't understand how this document is not sufficient.

Try to find anything else you can join. Go on the website to find what they accept. Send two more evidence if you can find any.... or call. Maybe they are giving you a hard time... and you can resolve the problem by talking to someone. Good luck !

Try to find anything else you can join. Go on the website to find what they accept. Send two more evidence if you can find any.... or call. Maybe they are giving you a hard time... and you can resolve the problem by talking to someone. Good luck !

I would make an infopass appointment in the meantime as sometimes there can be a bit of a wait. That way if you can't get the answers you need, you will be able to take everything you have to a USCIS officer for clarification. If you get it sorted beforehand, you can always cancel it. Good luck!

Pekan, it's very frustrating... maybe you have to prove that a birth certificate cannot be issued. I'm trying to find an answer for you.... All I could find was what is on the letter :

(2) Submitting secondary evidence and affidavits—(i) General. The non-existence or other unavailability of required evidence creates a presumption of ineligibility. If a required document, such as a birth or marriage certificate, does not exist or cannot be obtained, an applicant or petitioner must demonstrate this and submit secondary evidence, such as church or school records, pertinent to the facts at issue. If secondary evidence also does not exist or cannot be obtained, the applicant or petitioner must demonstrate the unavailability of both the required document and relevant secondary evidence, and submit two or more affidavits, sworn to or affirmed by persons who are not parties to the petition who have direct personal knowledge of the event and circumstances. Secondary evidence must overcome the unavailability of primary evidence, and affidavits must overcome the unavailability of both primary and secondary evidence.

So maybe, because they consider your "official vital records" a secondary evidence, and you have to prove hat an original birth certificate cannot be obtained. Maybe they are able to find original birth certificate from other people from Turkey and they don't understand you couldn't give them the same....

Radio silence for us since the biometrics appointment on Jan 7th. Today is my first day out of status as well, which I know is a common enough thing for a K1 adjustee, given the timescales involved but in "a period of stay authorized by the attorney general" sounds far more intimidating than simply "in status". :blink:
