Timeline

Update: attempted to have my driver's license done today in Florida and was refused because I did not go with my wife's passport. I brought with me: my passport with I-94, I-485 NOA1, 2 proof of address, marriage certificate and ssn card. I was given a letter to come back tomorrow and have it done by bringing my wife's passport or birth certificate.

I have a k1 which means US citizen but as frustrating as it is, it is progress none the less.

Will have it done first thing in the morning.

We've been moving into our new apartment the last few days so things have been hectic! But a quick update:

3x NOA texts/emails received on December 30th

3x NOA hardcopies received January 5th

Now waiting on the biometrics letter! Now the holidays are over I can finally get back into action - time to get my bank account opened and my drivers license! Congrats everyone who have got their NOAs and biometrics sorted already!

K1 Journey - 5 months and 1 day

NOA date - Feb 7 2018

My wife filed AOS and I-130 for our then ten month old daughter, and the USCIS received the case on DEC. 1.

Afterwards, we'd been informed that our daughter will have to attend the Biometrics appointment on this Friday (Jan. 8).

And minutes ago, I saw our daughter's I-485 case status has changed and indicated that "Case is ready to be Scheduled for an Interview."

Don't know if this is a good sign or on the opposite....

I read roughly that some people got their driver's license with the NOA1 ? Is that possible ?

DMV told me that I needed a letter with Approved or something on it. Can someone tell me if NOA1 worked out ?

Biometrics completed! ? (Atlanta)

My appointment was for 1pm but we left early and were waiting inside at 12 noon. I had my husband and our 15 month old son in tow. Waited around 10 minutes until security checked us in, completed a basic form and told to wait to be called. Just after 1pm I was called up. Fingerprinted and my photo taken. Out and back on the road 15 minutes later.

All in all a very simple step in the AOS journey.

Now, more waiting ?

Nope, I don't think it will work. In CA, the NOA that you need needs to specifically say:

  • Notice of Action (I-797 Approved Petition) - must indicate approved extension of stay or change in status that grants temporary or permanent residency, or indicates that an original, duplicate or renewal Resident Alien card is forthcoming.

Unfortunately, looks like we need to wait for EAD. You should be able to get the CA DL with your passport with the visa and the Form I-94, but they will probably only give it to you for the time when the I-94 expires.

My I-94 expires Jan 16. I guess I'll do what I've been and all of us have been doing....WAIT :)

1) What do you mean by you've changed your last name? You mean you legally went somewhere and changed it? Or you've applied for ssn or something in your new married name? In any case, generally I our marriage certificate along with your old maiden name ID generally works until you apply for everything in your new name.

2) you don't really need a second sponsor unless your husband/wife USC is out of a job or doesn't make enough to support you both. Generally to support a household of two, I think it said something along the lines of needing am income of like 20k a year or something. I'm not quite sure but it was 140% above the poverty line.

Thank you! But the 2nd question was about the "address proof"... My husband is (or supposed to lol) above the poverty line...

Just as a heads-up (which probably won't affect too many of us) the USCIS case tool will be down this coming Sunday:

  • FOIA Status Check
  • Office Locator
  • Forms by Mail

That's gonna be day 20 for us, so I wonder if we will be able to see our case after that? Or maybe we will be able to see our case Sunday, Jan. 9 at 11:59 p.m.! LOL! Next week starts a new pay period for me, so I am going to work a schedule that allows me to have a day off in hopes that we will get a biometric appointment within the next two weeks. My husband will start classes the week of Jan. 18th, so an appointment after that will cause him to interrupt his classes.

We didn't need to show anything regarding immigration nor residency. We do need to pay the out of state tuition rate, but that changes per state. He will qualify for the state tuition in November 2016.

We need to get his foreign classes evaluated, and that's going to be about $150 or so, but thankfully, we can wait a few months for that. Since his classes don't require prerequisites, we will give them the evaluations later - perhaps when he is ready to apply to a university. For now, he will be at the Dallas community college for about a year.
