Hi guys, I would like some advice please.

About two years ago I met a guy online. We became very good friends, fell in love and a couple of months ago I traveled to the States to be with him. I traveled on a tourist visa, although I did intend on staying indefinitely. Sold whatever belonging I didn't ship over, quit my job and gave up the flat I was renting to my roommates.

All went well until I realized my boyfriend was, although separated, still married! We had a huge fight and I came back home. I then discovered I was pregnant and my boyfriend and me made up. We don't have money at the moment, but we're hoping that I can go back after the baby is born.

What are our options? I still don't have a job and probably won't until after the baby is born. We thought about my boyfriend coming here, but he is close to retirement age. Thank you!

ditto, as said there is nothing he can do immigration wise until he is divorced if he hasn't done it yet

after he is divorced, he has two options, file for you as his fiancé, marry and adjust status in the US, or go to your country and marry

come back and file the i130 as married

There are reasons why he can't get divorced right now and I understand it. I mean, are there no other avenues to pursue? He's planning on coming here for the birth of our child and staying here with us for a few months until we can travel back to the States. Is there no way he can come over, I mean what kind of visa old he need? And if I want to travel back to our home n the States, is there any way he can sponsor me? If not, can I travel on a tourist visa with my baby?

How long were you admitted for on your original visit and how long did you stay ? If you stayed longer than your original admittance your visitors visa is cancelled and you may have a ban against coming back depending on how long you stayed. He won't be bringing you back with him unless he gets divorced. He would need a visitors visa to come to you unless you are in a visa waiver country.

This will not be over quickly. You will not enjoy this.

Is your boyfriend a US citizen or permanent resident? If a permanent resident then even after he divorces you can't go the fiancé visa route as that's only for us citizens.

If your boyfriend refuses to get a divorce then there is no legal route for you to live in America through him.

He can definitely come to you and stay with you during your child birth. He doesn't need to get divorced to come to you. However, like others said, for him to be able to sponsor you to be with him in US permanently, he has to first divorce his current wife.

Seems like you still have the valid visitor visa, you can definitely travel to US with the visitor visa (though entry to US is at the POE officer's discretion). Your baby will need a visa to be able to travel with you.

If your baby can get us citizenship from the father then they cannot get a visa but you must apply for a consular report of birth abroad in order to get a us passport for them. Children of us citizens who might of inherited cutizenship are not allowed a visa but must first be determined if eligible for citizenship. . If they deny this then you can apply for a visa.

Your visa might have been good for a year but what did your I-94 say as to how long you could stay. A tourist is not given more than 6 months to stay at a time.

Your chances of obtaining another tourist visa are slim to none given you already have an overstay, have or will have a USC child, no job or other ties to your home country.
