You may also need to have something to present at POE as that is the final step. I had a letter from my ex showing that he knew we were moving. It wasn't so much permission but more that he was aware of it. I wasn't asked for it but others before me had been so I wanted to be prepared.

If you have the full custody of the child, you may not required to present a consent letter from the bio-father/mother. Full custody gives you the right to decide solemnly on where the kids will live.

If your ex has the full custody or you two have joint custody, you will need her/his permission so consent letter will be required.

but that's true that some US embassies in some countries certainly requires this while some never asks. If it's easy for you to get such letter from the ex, I say get it. you may need it in the future if not now.

My son has German passport through my ex and I'm Turkish. We have been travelling internationally a lot with my son and have never been asked for any kind of permission/consent from his father. But I still got a letter of consent from his father and I always carry it with me along with the custody papers although I've never had to show it to anyone at airports inbound or outbund.

I didn't need one. I brought my step-daughter from her country to the US and flew back with her without so much as a wink from either immigrations officers. I stated that she was my step-daughter when they asked what the trip was for. No one asked if I had adopted her.

At the interview, they never asked one thing about her biological mother. They did ask if she knew me and how I felt about her coming. At the POE, her documents were reviewed, my name is not on any of her documents. NO one ever questioned it.

After reading some of these posts I must say I'm glad I'm from a country where you must either show you are the guardian or submit a permission letter from the other parent.

To be able to move a child to another country when you aren't even the legal guardian blows my mind.

In my case, my son has his own passport, he's not registered on my passport. While getting a passport, both parents apply together and already declare their consent for each other that the child can travel along with one of the parents so immigration officers do not ask for an additional consent from the non-travelling parent. Again, in my case, I could apply on my own for my son's passport. Since I have the full custody which means the court granted that consent on behalf of my ex and he approved, I just showed the paperwork and it was okay.

On the other hand, my son traveled with my ex internationally a few times and he was asked to show my consent. I even remember receiving a call from immigration office in Munich airport for asking me if I knew the situation. Immigration officers knows these all and if it is not legal, they will ask.
