On April 8, 2016, we denied your Form N-400, Application for Naturalization , Receipt Number *******. We mailed you a decision notice that explains why we denied your case and your options. Please follow the instructions in the notice.

What is the next possible step I can take?

Hi. I'm very sorry to hear that.

I'll explain your choices as I understand them and I'll give you my advice, but please remember that I'm no expert and I've been wrong before.

First of all let me say that if I had known about your situation from the start, I would have told you that you have about a 50/50 chance of approval or denial. That would have been just a guess of course, but cases where spouses don't live together are tough.

You have 4 choices:

1- Appeal. This costs money, but less than a new application. Someone new will review your application. I would guess that your chances are less than 50-50 because USCIS doesn't usually overturn decisions unles they find a mistake. There really wasn't a mistake; it came down to a subjective decision about whether or not you met the requirement stating that you love together in marital union. If you get a lenient revieew you'll be approved.

2- Reapply now. Your denial will be on your record and USCIS is reluctant to approve a second application unless the grounds for the initial denial have been addressed. If nothing has changed then a second denial is likely, but of course approval is possible.

3- Apply under the 3 year rule after moving in with your spouse. This addresses the concern of where you live now, but you'll need to wait and build up time to convince them that you are living together. Might as well apply under 5 year rule.

4- Apply when you are eligible under the 5 year rule. This is the safest option. You won't be asked to demonstrate that you are living with your spouse or anything about the current state of uour marriage. However, 5 year applicants who got their green cards through marriage are sometimes asked to demonstrate (again like during ROC) that they got their green cards legitimately. So you may have to show that you were living with your wife when you got your GC and for a while after that. The denial you got will make it more likely that you'll be asked about this, so take lots of evidence. But you should pass.

So if I were you, I would apply under the 5 year rule when that time comes.

Again, very sorry to see you get denied... Ever since your interview, I was trying to avoid being optimistic or pessimistic, because it really could have gone either way. Best of luck to you.

In some way the IO was a little transparent to advise that I should wait and apply under the 5 yr rule. I think the lawyer I consulted could have done a better job. I was optimistic that the Involuntary separation exceptions would apply in my case. I thought the IO took exception to me standing up for my right. When I spoke to the Tier 2, she asked me what happened at the interview? She wouldn't elaborate when I asked her if there was a note by the IO.

It Just sucks. I would consult a lawyer when I got the detail in the mail. Appeal will definitely cost me a lot of money with no approval guarantee.

11/22/12 = Filed I-751 to remove conditions

11/30/12 = Got NOA1 (I-797C)

12/23/12 = Got the bio-metrics done (USCIS Status: Pending)

I am an US citizen now. 16 people from 14 cointries. Very small ceremony. It all lasted less than 1 hour. Good luck to all of you still waiting!

Thanks Jimmy! I cannot believe that this is actually going to be happening. I am in Canada for work right now and cannot believe that when I head home on Wednesday evening, it will be the last time that I will be entering the US as legal permanent resident. So excited!! Good Luck to all of those that have their interviews this week...almost there!! Ms.Hogan, have you gone back to Canada since your interview? If so, have you driven over with NEXUS? I am just providing a supplemental sheet providing my dates of travel back and forth with that N455 that has to be presented before the oath ceremony. Hoping that I don't have any issues with this as Toronto is easier to drive from Buffalo then flying in and out.

Naturalization Ceremonies

The Tampa Field Office has Judicial Ceremonies on a monthly basis and Administrative Ceremonies on a weekly basis. The Tampa Field Office does have same-day ceremonies occasionally.

Hey Everyone,

I had my interview this morning and I got approved! I am scheduled for oath on April 22 at 7:30am.

I forgot to mention before that they scheduled my interview at Kendall office, and not Miami office. IO told me that Miami is little behind so they are sending applications to Kendall.

My interview was scheduled at 9:15am. I was called by IO, a very nice young lady, around 10am. We went to her office, i swore to tell the truth and she started with civics questions. I answered all 6, so we went to reading and writing. Then she started asking questions from my n400 form. Everything was going super fast. I was prepared to explain every question, but she was satisfied with short answers :) I was little worried when we got to "time outside US" because last year i spent 8 months traveling India and Europe. She just asked "why", and she was fine with my answer.

She didn't ask so much about my marriage. She only asked "who lives with you at this address?" and when I said my husband she just asked "is it only two of you?". And that was it. I was so nervous after reading experiences from other VJs who applied under 3 years rule. Also, she didn't ask for any extra documents, so I told her that i have 2015 tax return and lease agreement with both of our names which i didn't submit with application. She took that. Then she said that i am approved and to go to waiting room and wait for oath letter. I waited about 30 minutes for that.

When i got home i remembered that she didn't ask me to sign pictures. Did everyone do that?

I'm so happy i'm done with the interview! Just oath ceremony and passport left :)
